A Statement may be delivered by the Buyer to the Supplier by electronic means and shall include the reference number assigned to this Agreement by the Buyer and a description of the components of the Monthly Payment and other payments, as described in this Agreement, including Section 4.1 as applicable, owing to the Supplier for the Settlement Month.
The DSO shall remit to the Participant full payment in respect of the Statement no later than twenty (20) Business Days after the end of the Settlement Month to which the Statement relates, which payment shall be made by electronic funds transfer to the Registered Bank Account or as otherwise agreed by the Parties.
Any such Force Majeure shall also reduce the payment being made to the Supplier by way of the same Force Majeure Capacity Reduction Factor applied to the Monthly Capacity Payment for the applicable Settlement Month.
Delivery or Settlement Month means the calendar month in which a futures contract may be settled by making or taking delivery or by making or receiving a cash settlement of the contract.
The Buyer shall prepare and deliver a settlement statement (the “Statement”) to the Supplier, within twenty (20) Business Days after the end of each calendar month in the Term that is the subject of the Statement (the “Settlement Month”), setting out the basis for the Monthly Payment with respect to the Settlement Month, as well as the basis for any other payments owing under this Agreement by either Party to the other in the Settlement Month.
