Settlement Subclass definition

Settlement Subclass means any member of the Settlement Class who had their Social Security number, driver’s license, and/or financial information (credit and/or bank account information) potentially compromised in the Incident.

More Definitions of Settlement Subclass

Settlement Subclass or “Settlement Subclass Members” means all Proposed Settlement Subclass Members, exclusive of any person who timely opts out of the Settlement pursuant to the procedures set forth below. All persons who timely opt out from the Settlement in conformity with this Agreement shall not be bound by the terms of this Agreement or any Final Judgment entered by the Superior Court, and shall retain the right to pursue any alleged individual claim(s) against FPG in a separate action.
Settlement Subclass means all individuals whose Social Security, financial account, bank account, and/or driver’s license numbers may have been accessed in the Data Incident announced by DCA in or after October 2020.
Settlement Subclass or “California Subclass” means all persons identified by Defendant (or its agents or affiliates) as being individuals residing in California impacted by the Data Incident, including all who were sent a notice of the Data Incident. The Settlement Subclass specifically excludes: (i) Defendant and its respective officers and directors; (ii) the Judge(s) to whom the action is assigned and any member of those Judges’ staffs or immediate family members; and (iii) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Incident or who pleads nolo contendere to any such charge.

Anyone excluded from the Class is also excluded from the Settlement Subclass.
