Shared Facilities Costs definition

Shared Facilities Costs means the aggregate of all costs and expenses incurred in connection with the Shared Facilities from time to time, as provided in this Agreement and set out on Schedule “D” attached hereto, and shall include without limitation, the costs and expenses incurred in connection with the maintenance, repair and operation of the Shared Facilities, including without limitation, the cost of maintaining and repairing all electrical and mechanical equipment, fixtures and installations comprising same or appurtenant thereto, together with the amount of any municipal, provincial or federal taxes and/or any common expense assessments attributable to the Shared Facilities (or any portion thereof);
Shared Facilities Costs means the costs of operating, maintaining and repairing the Shared Facilities and shall include the Common Costs *(as defined in the Reciprocal Agreement);
Shared Facilities Costs means the aggregate of all costs and expenses incurred, including reasonable management expenses, in connection with the Shared Facilities, and shall include without limitation, the costs and expenses incurred in connection with the following, namely the operation, servicing, maintenance, repair and/or replacement of the POPs, the Common Interior Roadway and the Shared Servicing Systems (together with all appurtenant roadway services, such as drains, pipes, cables, lighting, etc. located within or beneath the boundaries of the Common Interior Roadway serving and benefitting the Common Interior Roadway; the storm water management system, including the storm water management retention facilities and any appurtenant drains, pipes, swales and channels servicing and benefiting any of Lands; and walkways and side walks and any appurtenant cables and lightings, servicing any of the Lands), the cost of procuring all requisite fire, property damage and public liability insurance coverage for the Condominiums with respect to damage and/or injury occasioned to persons and/or property upon or within Shared Facilities;

Examples of Shared Facilities Costs in a sentence

  • Tenant shall pay all of the costs of Tenant’s accountant/auditor associated with such examination and dispute, unless it is finally determined that Tenant was overbilled with respect to Operating Expenses, Net Shared Facilities Costs or Taxes by more than five percent (5%) (considering each of the foregoing separately), in which case, Landlord shall pay the reasonable costs of Tenant’s accountant/auditor with respect to such Operating Expenses, Net Shared Facilities Costs or Taxes, as the case may be.

  • Net Rent, Additional Rent for Taxes, Operating Expenses and Net Shared Facilities Costs, Additional Rent pursuant to Paragraph 3(G) above, and any other amounts which Tenant is or becomes obligated to pay Landlord under this Lease or other agreement entered in connection herewith, are sometimes herein referred to collectively as “Rent,” and all remedies applicable to the non-payment of Rent shall be applicable thereto.

  • Pending resolution of any such exceptions in the foregoing manner, Tenant shall continue paying Taxes, Operating Expenses and Net Shared Facilities Costs in the amounts determined by Landlord, subject to adjustment after any such exceptions are so resolved.

  • The Operating Costs and the costs for the Transitional Services shall together be referred to as the "Shared Facilities Costs".

  • Shared Facilities Costs shall include, without limitation, ordinary and capital costs for labor and materials, equipment costs, utility charges, costs of security, janitorial services, landscaping and pest control and management and accounting fees and all other costs related thereto.

More Definitions of Shared Facilities Costs

Shared Facilities Costs means, relative to a Shared Facility, the costs of management, repair, maintenance and operation of such Shared Facility, to the extent such costs exceed the costs (the “Normal Office Costs”) which would have been incurred if the premises constituting the Shared Facility had not been used for a fitness center or a cafeteria but had instead been used for general office purposes (it being agreed that such Normal Office Costs shall constitute Operating Expenses includable under Paragraph 3(B)(ii) above), but excluding any such costs that are payable by managers, operators, concessionaires and licensees and are not payable by Landlord. For purposes of illustration only, (a) HVAC for the Shared Facilities during Regular HVAC Hours shall be included in Operating Expenses and HVAC for the Shared Facilities outside of Regular HVAC Hours shall be included in Shared Facilities Costs, and (b) if Landlord shall provide cleaning or trash removal service to the Shared Facilities then (i) the costs thereof, up to the cost of cleaning or trash removal which would have been incurred if the Shared Facilities had not been used for a fitness center or a cafeteria but had instead been used for general office purposes shall be included in Operating Expenses and (ii) the balance of such costs shall be included in Shared Facilities Costs; (c) if the operator, licensee or concessionaire shall provide cleaning or trash removal to the Shared Facilities then Operating Expenses and Shared Facilities Income shall each be increased by the costs which Landlord would have incurred if the Shared Facilities had not been used for a fitness center or a cafeteria but had instead been used for general office purposes; and (d) the cost of electricity provided to the Shared Facilities shall be excluded from Operating Expenses and included in Shared Facilities Costs.

Related to Shared Facilities Costs

  • Future Facilities Costs means the CFD Public Facilities minus (i) public facility costs previously paid from the Construction Fund, (ii) moneys currently on deposit in the Construction Fund, and (iii) moneys currently on deposit in an escrow fund that are expected to be available to finance facilities costs.

  • Shared Facilities means the gen-tie lines, transformers, substations, or other equipment, permits, contract rights, and other assets and property (real or personal), in each case, as necessary to enable delivery of energy from the Facility (which is excluded from Shared Facilities) to the point of interconnection, including the Interconnection Agreement itself, that are used in common with third parties.

  • Existing Facilities means all existing buildings and other facilities, the sites for the buildings or facilities, and furnishings or equipment for the buildings or facilities located on real property acquired by the building authority under the terms of this act.
