Examples of Shared Facilities Costs in a sentence
Tenant shall pay all of the costs of Tenant’s accountant/auditor associated with such examination and dispute, unless it is finally determined that Tenant was overbilled with respect to Operating Expenses, Net Shared Facilities Costs or Taxes by more than five percent (5%) (considering each of the foregoing separately), in which case, Landlord shall pay the reasonable costs of Tenant’s accountant/auditor with respect to such Operating Expenses, Net Shared Facilities Costs or Taxes, as the case may be.
Net Rent, Additional Rent for Taxes, Operating Expenses and Net Shared Facilities Costs, Additional Rent pursuant to Paragraph 3(G) above, and any other amounts which Tenant is or becomes obligated to pay Landlord under this Lease or other agreement entered in connection herewith, are sometimes herein referred to collectively as “Rent,” and all remedies applicable to the non-payment of Rent shall be applicable thereto.
Pending resolution of any such exceptions in the foregoing manner, Tenant shall continue paying Taxes, Operating Expenses and Net Shared Facilities Costs in the amounts determined by Landlord, subject to adjustment after any such exceptions are so resolved.
The Operating Costs and the costs for the Transitional Services shall together be referred to as the "Shared Facilities Costs".
Shared Facilities Costs shall include, without limitation, ordinary and capital costs for labor and materials, equipment costs, utility charges, costs of security, janitorial services, landscaping and pest control and management and accounting fees and all other costs related thereto.
Buyer shall pay its share of all other costs included within the Shared Facilities Costs within twenty (20) days of the date Jenoptik has given Buyer notice that it has made a payment together with a copy of the relevant invoice billed to Jenoptik by the utility, landlord or service provider.
However, insofar as any costs included in the Shared Facilities Costs are increased by a third party not affiliated with Jenoptik, Buyer shall be responsible for its proportionate share of any such increase.
Manager shall allocate among the Unit Owners all Shared Facilities Costs, including operating and capital expenses, in accordance with applicable provisions of the Declaration (it being acknowledged, however, that Owner currently is the fee owner of the entirety of the Project and shall pay all Shared Facilities Costs as authorized by this Agreement before and after execution of the Declaration until a Unit is sold or transferred to another party).
Landlord shall cause Other Tenants to prepay to Landlord three months of Shared Facilities Costs in order to insure prompt payment thereof.
Within thirty (30) days following the expiration or earlier termination of this Agreement, unless otherwise agreed, Manager shall provide a final accounting to Owner in such form as requested by Owner, of the Shared Facilities Costs and any other costs incurred by Manager (on behalf of Owner or any other Unit owner) during the term of this Agreement.
