Substantial Completion Guaranteed Date definition

Substantial Completion Guaranteed Date means January 1, 2014 as the same may be extended pursuant to Articles XVI, and Sections 8.04, 22.02 and 23.07, provided a Full Notice to Proceed is issued by Owner no later than April 1, 2012.
Substantial Completion Guaranteed Date means the date that is no later than twenty (20) months after the Starting Date of Construction as extended (if applicable) for so long as necessary (i) for the Gas Purchaser to connect the Plant to the grid; (ii) to account for extreme weather conditions during construction and/or due to other Events of Force Majeure; or (iii) to account for or delays due to Principal including Principal’s delay in providing the Plant with Sufficient Substrates. This date coincides with the start of the liquidated damages if the Contractor is late meeting this guaranteed date.
Substantial Completion Guaranteed Date means, with respect to the first Unit, the date of ***, and, with respect to the second Unit, the date of ***, as such dates may be modified in accordance with the terms hereof.

  • The CPM Schedule shall represent Contractor's best judgment as to how it shall complete the Work in compliance with the Schedule Milestones including the Phase Substantial Completion Guaranteed Dates, the PV Power Plant Substantial Completion Guaranteed Date, and the Final Completion Guaranteed Date.

  • If the Project fails to achieve the Substantial Completion Date on or prior to close of business on the Substantial Completion Guaranteed Date, then Developer shall pay to PacifiCorp liquidated damages for each day until the Project achieves the Substantial Completion Date, in an amount equal to [ ($ )] per day for the first thirty-one (31) days following the Substantial Completion Guaranteed Date and [ (collectively, the “Delay Liquidated Damages”).

  • The frequency of such meetings shall be established and modified, from time to time, by mutual agreement of the Parties; provided, however, such meetings shall occur no less frequently than monthly; provided, further, if the Milestone Summary Schedule indicates that Substantial Completion is scheduled to occur thirty (30) days or more after the Substantial Completion Guaranteed Date, Owner shall be entitled to require that meetings occur as frequently as weekly.

  • Without limiting the foregoing, Contractor shall, subject to the terms and conditions of this Agreement, including Section 15.1, perform the Work so as to achieve Substantial Completion of each Unit by such Unit’s Substantial Completion Guaranteed Date.

  • If an event described in Section 16.1(g) occurs, the Project Schedule (and the Substantial Completion Guaranteed Date referenced therein for Unix 0 xx Unit 2, as applicable) shall be equitably extended as necessary for the repair of such welds and as set forth in a Change In Work Form accepted by Owner; provided that Contractor uses all reasonable efforts to mitigate the duration of any delay in achieving the Substantial Completion Guaranteed Date.


More Definitions of Substantial Completion Guaranteed Date

Substantial Completion Guaranteed Date means the date that is no later than thirteen (13) months after the Starting Date of Construction as extended (if applicable) for so long as necessary (i) for the Power Purchaser to connect the Plant to the grid, so long as delay is not caused by Contractor’s default of its obligations under this Agreement; (ii) to account for extreme weather conditions during construction and/or due to Events of Force Majeure; (iii) to account for or delays due to any actions or omissions of Principal in breach of this Agreement, including Principal’s delay in providing the Plant with Sufficient Substrates; or (iv) as required due to changes to the Workflow Plan agreed to by Principal;
Substantial Completion Guaranteed Date means the Phase 1 Substantial Completion Guaranteed Date, the Phase 2 Substantial Completion Guaranteed Date, the Phase 3 Substantial Completion Guaranteed Date, the Phase 4 Substantial Completion Guaranteed Date, or the PV Power Plant Substantial Completion Guaranteed Date, as applicable.
Substantial Completion Guaranteed Date means the date of August 31, 2009, as such date may be modified in accordance with the terms hereof.

Related to Substantial Completion Guaranteed Date

  • Guaranteed Substantial Completion Date or “Guaranteed Substantial Completion Dates” has the meaning set forth in Section 5.3B.

  • Substantial Completion Date means the date on which Substantial Completion occurs.

  • Completion Guaranty means the Guaranty of Completion and Payment of even date herewith from Indemnitor for the benefit of Lender, as amended from time to time.

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory.   • Construction Completion Date means the Completion Date of the Construction as specified in the Statutory Declaration of Completion for the Project;

  • Guaranteed Construction Start Date means the Expected Construction Start Date, as such date may be extended by the Development Cure Period.

For the Hotel to be considered under construction, youmust have begun to pour concrete foundations for the Hotel or otherwise satisfied any site-specific criteria for “under construction” set out in the Addendum.
