TDM Output definition

TDM Output means the result of any Text and Data Mining activity or operation, capable of fixation, reproduction and/or communication in any form, such as the creation of an index, reference, abstract, relative or absolute description or representation of the Licensed Products, an algorithm, formula, metrics, method, standard or taxonomy describing or based on the Licensed Products, a relational expression or measurement, whether scalable or not, of the Licensed Products, extraction, alternative representation or translation, expression or discussion of any extracts from mined the Licensed Products, whether in the form of a direct extraction or a representation in any form which is based on the Licensed Products.
TDM Output means the result of any Text and Data Mining activity or operation, capable of fixation, reproduction and/or communication in any form, including without limitation the creation of an index, reference, abstract, relative or absolute description or representation of Content, an algorithm, formula, metrics, method, standard or taxonomy describing or based on Content, a relational expression or measurement, whether scalable or not, of Content, extraction, alternative representation or translation, expression or discussion of any extracts from mined Content, whether in the form of a direct extraction or a representation in any form which is based on Content.
TDM Output means the data and information which is the result of any TDM, excluding, however, any verbatim duplication of the Content in whole or in part. For the avoidance of doubt, Authorized Users may use parts of the Content for citation purposes in connection with the TDM Output, if and to the extent such citations is allowed by Finnish copyright law.

Prohibited uses The prohibited uses applicable to Member’s and Authorized Users’ use of the Content set forth in Section 4 of the License Agreement shall apply to the license grant hereunder. Without limiting the foregoing, Member and its Authorized Users may not (i) create derivative products or services that would compete with or negatively affect Licensor or Licensor’s affiliates products or services, or otherwise commercially use or allow commercial use of the TDM Output, (ii) allow a third party to access or use any TDM Materials, (iii) perform TDM for a third party, or (iv) store, or permit storage of, Licensed Materials or TDM Materials on any server other than an Internal Server. This Section 2 shall survive any expiration or termination of this License Agreement, howsoever arising. Security, Formats and Delivery Mechanisms Member will (i) use reasonable measures to protect the security of the Licensed Materials downloaded for TDM purposes and the TDM Materials in its possession or control. (ii) at Licensor’s request, permit Licensor to review relevent network and computer security documentation, and (iii) require that any Authorized Users that download the Licensed Materials for TDM purposes onto personal devices not in the possession or control of Member ensure that such devices employ commercially reasonable security measures.
