Transfer Protections definition

Transfer Protections means, in relation to a transfer of User data outside the European Economic Area (EEA) (including any such transfers to Company entities and/or to subprocessors of Company or its entities), measures to enable the transfer to be made in compliance with Applicable Laws and EU Data Protection Laws, including without limitation where the recipient of such data: (i) receives such data in a country that the European Commission has decided provides adequate protection for personal User data, (ii) has achieved binding corporate rules authorization in accordance with Applicable Laws and EU Data Protection Laws, (iii) has executed standard contractual clauses adopted or approved by the European Commission, or (iv) has in place an alternative mechanism that complies with Applicable Laws and EU Data Protection Laws for the transfer of personal User data outside the EU.
Transfer Protections means transfer protection measures required to enable a transfer to be made in compliance with Applicable Data Protection Law, including (as applicable) the recipient having: (i) achieved Binding Corporate Rules (as defined in Applicable Data Protection Law) authorization in accordance with Applicable Data Protection Law; (ii) executed Standard Contractual Clauses adopted or approved by the European Commission, or recognized in the UK, as applicable; or (iii) in place an alternative mechanism that complies with Applicable Data Protection Law for the transfer of Customer Personal Data to the applicable region.

Examples of Transfer Protections in a sentence

  • When marketing to Users that reside in the EEA, Company shall not transfer any User data outside of the EEA unless it has taken steps to ensure Transfer Protections, but subject to such Transfer Protections, Advertiser agrees that Company shall process User data in countries where Company or its subprocessors maintain facilities or personnel as necessary so Company may fulfill its obligations under the Agreement.

  • Customer further agrees that those subprocessors may be based outside of the state, province, country, or other jurisdiction in which Customer has chosen to store Customer Personal Data, subject to Rackspace taking steps to ensure Transfer Protections if transfers are made to those subprocessors.

  • The parties agree that the Model Clauses set out in Exhibit 1 apply only if (i) Customer Personal Data to which Applicable Data Protection Law applies is transferred to the Applicable Rackspace Entity and its subprocessors located in a country that is outside of the EEA, and (ii) no Transfer Protections other than Model Clauses have been provided.

Related to Transfer Protections

  • Consumer Protection Act means the Consumer Protection Act, No. 68 of 2008 (as amended from time to time).

  • Applicable Data Protection Law means all data privacy or data protection laws or regulations globally that apply to the Processing of Personal Information under this Data Processing Agreement, which may include Applicable European Data Protection Law.

  • Fire Protection means all aspects of fire safety including but not limited to fire prevention, firefighting or Fire Suppression, pre-fire planning, fire investigation, public education and information, training or other staff development;

  • Applicable Data Protection Legislation means any national or internationally binding data protection laws or regulations (including but not limited to the GDPR and the Austrian Data Protection Act (“DSG”)) including any requirements, guidelines and recommendations of the competent data protection authorities applicable at any time during the term of this DPA to, as the case may be, the Data Controller or the Data Processor;

  • Data Protection Laws and Regulations means all laws and regulations, including laws and regulations of the European Union, the European Economic Area and their member states, Switzerland and the United Kingdom, applicable to the Processing of Personal Data under the Agreement.

  • Data Protection Act means Act CXII of 2011 on Informational Self-Determination and Freedom of Information.

  • Data Protection Acts means Data Protection Act 1988, as amended by the Data Protection (Amendment) Act 2003, and as may be modified, amended, supplemented, consolidated or re- enacted from time to time;

  • General Data Protection Regulation GDPR" means regulation (EU) 2016/679 of the European parliament and of the council as amended from time to time.

  • EP Regulations means The Environmental Permitting (England and Wales) Regulations SI 2016 No.1154 and words and expressions used in this permit which are also used in the Regulations have the same meanings as in those Regulations.

  • Securities Transfer Act means the Securities Transfer Act (British Columbia) from time to time in force and all amendments thereto and includes all regulations and amendments thereto made pursuant to that Act.

  • Data Protection means the implementation of appropriate administrative, technical or physical means to guard against unauthorized intentional or accidental disclosure, modification, or destruction of data.

  • PPPFA Regulations means the Preferential Procurement Regulations, 2017 published in terms of the PPPFA.

  • Securities Trading Act means the Securities Trading Act of 2007 no.75 of the Relevant Jurisdiction.

  • Regulations means the Income Tax Regulations promulgated under the Code, as such regulations may be amended from time to time (including corresponding provisions of succeeding regulations).
