User Data. We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
User Data. In addition to any disclosures authorized by Section 24, You and Your Authorised Users consent and agree that the RIM Group of Companies may access, preserve, and disclose Your or Your Authorised Users' data, including personal information, contents of your communication or information about the use of Your BlackBerry Solution functionality and the services or software and hardware utilized in conjunction with Your BlackBerry Solution where available to RIM ("User Data"), to third parties, including foreign or domestic government entities, without providing notice to You or Your Authorized Users under the laws of countries where the RIM Group of Companies and its service providers, other partners and affiliates are located in order to: (i) comply with legal process or enforceable governmental request, or as otherwise required by law; (ii) cooperate with third parties in investigating acts in violation of this Agreement; or (iii) cooperate with system administrators at Internet service providers, networks or computing facilities in order to enforce this Agreement. You warrant that You have obtained all consents necessary under applicable law from Your Authorised Users to disclose User Data to the RIM Group of Companies and for the RIM Group of Companies to collect, use, process, transmit, and/or disclose such User Data as described above.

User Data. The Cloud Service (including SAP Analytics Cloud, embedded edition) has features which collect certain usage information directly from users only for purposes of personalized search results and recommendations, and to help SAP to plan and prioritize features, improve product design, and improve documentation and resources. By default, these features are disabled but will be offered to each user, who upon initial sign-on can choose to opt-in to these features. These features can be turned off at any time by the user, or by the Tenant administrator. The Tenant administrator settings will affect all users.
User Data a) You agree that if You use the Platform to distribute Products, You will protect the privacy and legal rights of users. You agree to only collect and use user data in accordance with the terms and conditions of Your Terms of Use and/or End User License Agreement and Privacy Policy You publish in conjunction with Your Products and applicable laws. You shall ensure that each user receives sufficient notification prior to any collection of their data. This notice must clearly and expressly state that their data shall be collected by You and is subject to Your Terms of Use and/or End User License Agreement and Privacy Policy. You must also ensure that each user provides affirmative consent prior to such collection and any use of the data by You or any third party on Your behalf. You agree to take all steps required and reasonably necessary (including appropriate physical, technical, and organizational measures) to protect such user data in Your possession or control against loss and unauthorized or unlawful access, use, modification, disclosure, processing or other misuse. You agree to implement and comply with industry-standard measures with respect to the technical and physical security of such user data. You agree to ensure that its collection, use, storage, processing, distribution, or transfer (including cross-border transfers), and Your information technology platforms and systems on which such user data is collected, used, stored, processed, distributed, or transferred are at all times compliant with applicable law (including all privacy laws and laws governing data security) and the terms and conditions of Your published use and privacy policies. Your standard of care to comply with Your obligations under the foregoing sentences shall conform to the requirements of applicable laws and industry standard security measures with respect to the sensitivity of the user data in Your possession or control. If users provide Your Product with Platform Provider account information, Your Product may only use that information to access the user’s Platform Provider account when, and for the limited purposes for which, the user has given You permission to do so.
b) In order to innovate and improve the Platform, Platform Provider may collect certain usage data from the Platform and Your Products, including but not limited to, information on how the Platform and Your Products are being used. User Data. “User Data” shall mean any Personal Data or other data or information collected by or on behalf of any Acquired Corporation from users of any Acquired Corporation website.

(a) All data or other information collected by iVillage from users of the iVillage Sites independent of the relationships, activities or offers covered by this Agreement and without referencing or solicited in connection with any AT&T Xxxx or any AT&T product or service ("iVillage User Data"), is the proprietary and Confidential Information of iVillage; provided that, during the Term, iVillage agrees it shall not use any iVillage User Data in connection with the marketing, promotion, or distribution of any Telecommunication Services, except Telecommunications Services offered by AT&T and Unavailable Telecommunication Services (as defined in Section 2).
(b) All data or other information, no matter how collected, concerning any of AT&T's products or services, concerning users' use of or interest in any AT&T product or service, or derived from or obtained during the use, promotion, marketing or other activities related to any AT&T's products and services (including, without limitation, the Promoted AT&T Services and the AIC Trial), whether such data or information is obtained on the iVillage Sites or otherwise, is the proprietary and Confidential Information of AT&T, including, without limitation, information (individually, in the aggregate, or otherwise), identifying AT&T customers, their usage patterns, their product preferences, etc. ("AT&T User Data"). iVillage may not use any AT&T User Data, except in connection with the promotion of AT&T's products and services in accordance with this Agreement.
User Data. 6.1 The Customer shall own all right, title and interest in and to all of the Customer Data and shall have sole responsibility for the legality, reliability, integrity, accuracy and quality of the Customer Data.
6.2 virtualDCS shall, in providing the CloudCover Services, comply with its Data Privacy and Compliance Policy available from the login screen or such other website address as may be notified to the Customer from time to time, as such document may be amended from time to time by virtualDCS in its sole discretion. In the event of any serious loss or damage to Customer Data, the Customer's sole and exclusive remedy shall be for virtualDCS to use reasonable commercial endeavours to restore the lost or damaged Customer Data from the latest back- up of such Customer Data maintained by virtualDCS. virtualDCS shall not be responsible for any loss, destruction, alteration or disclosure of Customer Data caused by any third party (except those third parties sub-contracted by virtualDCS to perform services related to Customer Data maintenance and back-up).
6.3 If virtualDCS processes any personal data on the Customer's behalf when performing its obligations under this Agreement, the parties record their intention that the Customer shall be the data controller and virtualDCS shall be a data processor and in any such case:
(a) the Customer shall ensure that the Customer is entitled to transfer the relevant personal data to virtualDCS so that virtualDCS may lawfully use, process and transfer the personal data in accordance with this Agreement on the Customer's behalf;
(b) the Customer shall ensure that the relevant third parties have been informed of, and have given their consent to, such use, processing, and transfer as required by all applicable data protection legislation; and
(c) each party shall take appropriate technical and organisational measures against unauthorised or unlawful processing of the personal data or its accidental loss, destruction or damage.
