Unable to perform the functions of the position means when an Employee is “unable to perform the functions of the position” where the health care provider finds that the Employee is unable to work at all or is unable to perform any one of the essential functions of the Employee’s position with or without a reasonable accommodation.
Unable to perform the functions of the position means the circumstance in which a health care provider finds that the employee is unable to work at all or is unable to perform any one of the essential functions of the employee’s position within the meaning of the American with Disabilities Act (ADA), 42 USC 12101 et. seq., and the regulations at 29 CFR 1630.2(n). Unable to perform the functions of the position means an employee is (1) unable to work at all, or (2) unable to perform any one of the essential functions of the employee’s position. In accordance with the Americans with Disabilities Act, the term “essential functions” means “the fundamental job duties of the employment position,” and does not include the marginal functions of the position.
