Uninsured Motorist definition

Uninsured Motorist means the owner of a motor vehicle, including the resident relatives or dependents of the owner, who is uninsured under either the personal injury protection system described in Section 4 of this act or the tort maintenance system described in Section 5 of this act:
Uninsured Motorist or supplementary "No-Fault", or optional coverage. Such coverage, if the obligation of SHRCO, shall be in a form acceptable to STTC and SHRCO shall deliver all policies of insurance, or evidence satisfactory to STTC of such coverage, prior to delivery to SHRCO of any Vehicle covered by this lease. Each insurer shall agree, by endorsement upon the policy issued by it, or by an independent document provided to STTC, that it shall give STTC thirty (30) days' prior written notice of the effective date of any alteration or cancellation of such policy and that such notice shall be sent in the manner contemplated by Article 6. SHRCO shall notify STTC as well as SHRCO's insurance company, of any loss of, or damage to, or accident involving any Vehicle, immediately by telephone, and in writing as soon as practicable thereafter, and to cooperate fully in the investigation, prosecution and/or defense of any claim or suit and to do nothing to impair or invalidate any applicable liability, physical damage or cargo coverage. SHRCO shall provide in each vehicle proof of financial responsibility.
Uninsured Motorist means the owner or operator of a motor vehicle: a . whose ownership, operation, maintenance, or use of that motor vehicle: (i) is not insured by a bodily injury liability bond or policy at the time of the accident; or (ii) is insured by a bodily injury liability bond or policy at the time of the accident, but the bonding or insuring company denies coverage or is or becomes insolvent: b . who cannot be identified but: (i) the insured person, or someone on his or her behalf, reports the accident to the police or civil authority within 24 hours or as soon as practicable after the accident; and (ii) independent corroborative evidence exists to prove that the bodily in- jury to the insured person was proximately caused by the negligence or intentional actions of the unidentified operator of the motor vehi- cle . The testimony of an insured person seeking recovery from us shall not constitute independent corroborative evidence, unless the testimony is supported by additional evidence; or c . who has diplomatic immunity . An “uninsured motorist” does not include an owner or operator of a motor vehicle: a . that is owned by you or a relative or furnished or available for the regular use of you or a relative; b . that is owned or operated by a self-insurer under any applicable motor vehicle law, except a self-insurer that is or becomes insolvent; c . that is owned by any governmental unit or agency unless the operator of the motor vehicle has immunity under Chapter 2744 of the Ohio Revised Code (relating to certain political subdivisions operating a fire department, police department, or emergency medical service); d . that is a covered auto; or e . that is owned or operated by an underinsured motorist .
