With respect to Products or Software or partial assembly of Products furnished by Seller but neither manufactured by Seller nor purchased by Seller pursuant to its procurement Specifications ("Vendor Items"), Seller, to the extent permitted, does hereby assign to Customer the warranties given to Seller by its vendor(s) of such Vendor Items.

Corvis will promptly provide, or cause the respective manufacturer to provide, to Customer any changes comparable to Class A and Class B Changes to the extent they are made available by manufacturers with respect to Vendor Items sold to Customer by Corvis; it being understood that the respective manufacturers of the Vendor Items may not provide such changes for the same period of time for which Corvis is obligated to provide Class A and Class B changes.
Corvis will promptly provide, or cause the respective manufacturer to provide, to Customer any changes comparable to Class A and Class B Changes to the extent they are made available by manufacturers with respect to Vendor Items sold to Customer by Corvis.
However, such Third Party Vendor Items may carry their own warranties and Nortel Networks shall pass through to Customer any such warranties to the extent authorized.
The indemnity provided herein shall not extend to any legal action based upon any infringement or alleged infringement of any patent, trademark or copyright by Vendor Items, or by the combination of any Hardware furnished by Nortel with other equipment not furnished by Nortel.
