FREE CONSENT. Each party acknowledges having decided, freely and without restraint, the termination of the employment contract. The parties acknowledge having defined the terms of the present Agreement during several discussions, including those held on October 29 and November 24, 2010. Prior to these discussions, HYPERCOM informed Xx. Xxxxx XXXXXXXX of his right to be assisted. During the discussions, Xx. Xxxxx XXXXXXXX chose not to be assisted. As a result, the employer did not make use of its right also to be assisted during those discussions.
