Common use of RUE DU COMMERCE’s liability Clause in Contracts

RUE DU COMMERCE’s liability. RUE DU COMMERCE’s sole function is to provide the Merchant Partner with its market space and access to its customer base, thus enabling the Merchant Partner to make sales. RUE DU COMMERCE is bound by a best endeavours obligation and undertakes to invest reasonable resources in the implementation of the Merchant Partnership Contract and in compliance with these Terms and Conditions. RUE DU COMMERCE may not be held liable for damage such as: - Operating, data or information loss, - Any technical or software malfunction in relation to the website or software, - Any failure, delay, computer virus or bug or interruption of internet access. RUE DU COMMERCE assumes no liability for losses related to such malfunctions. In any event, the maximum amount of compensation may not exceed the annual amount of commission paid by the Merchant Partner to XXX XX XXXXXXXX.
