Accounting for Disclosures of PHI. The Business Associate agrees to provide to Covered Entity or to an Individual, or Individual’s designee, in time and manner designated by Covered Entity, information collected in accordance with this Agreement, to permit Covered Entity to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 C.F.R. § 164.528. The Covered Entity shall forward the Individual’s request requiring the participation of the Business Associate to the Business Associate in a timely manner, after which the Business Associate shall provide such information as follows: (a) If Covered Entity directs Business Associate to provide an accounting of disclosures of the Individual’s PHI directly to the Individual, the Business Associate shall have sixty (60) days from the date of the Individual’s request to provide access to or deliver such information to the Individual or Individual’s designee. The Covered Entity shall provide notice to the Business Associate in time to allow the Business Associate a minimum of thirty (30) days to timely complete the Individual’s request. (b) If the Covered Entity elects to provide the accounting to the Individual, the Business Associate shall have thirty (30) days from date of Covered Entity’s notice of request to provide information for the Accounting to the Covered Entity so that the Covered Entity may timely respond to the Individual within the sixty (60) day period. (c) If either of the Parties is unable to complete the response to the request in the times provided above, that Party shall notify the Individual with a written statement of the reasons for the delay and the date by which the Party will complete its action on the request. The Parties may extend the response time once for no more than thirty (30) additional days. (d) The accounting of disclosures shall include at least the following information: (1) date of the disclosure; (2) name of the third party to whom the PHI was disclosed, (3) if known, the address of the third party; (4) brief description of the disclosed information; and (5) brief explanation of the purpose and basis for such disclosure. (e) The Parties shall provide one (1) accounting in any twelve (12) months to the Individual without charge. The Parties may charge a reasonable, cost-based fee, for each subsequent request for an accounting by the same Individual if he/she is provided notice and the opportunity to modify his/her request. Accounting for Disclosures of PHI. Business Associate shall maintain a record of any disclosure of PHI to a third party for a purpose other than Treatment, Health Care Operations, Payment, or pursuant to an authorization signed by the individual or personal representative of the individual who is the subject of the record. To the extent that Business Associate provides an electronic health record to MCO’s enrollees or customers, Business Associate shall comply with the requirements of 42 U.S.C. § 17935(c) and the regulations promulgated there under. Within thirty (30) days of notice by MCO to the Business Associate that it has received a request for an accounting of disclosures of PHI regarding an individual, the Business Associate shall make available to MCO such information as is in the Business Associate’s possession and is required for MCO to make the accounting required by 45 C.F.R. § 164.528. Business Associate shall provide such information in electronic form, where available in such form. In the event the request for an accounting is delivered directly to the Business Associate, the Business Associate shall, within five (5) days, forward such request to MCO. MCO shall be responsible for preparing and delivering any such accounting to the individual.
Accounting for Disclosures of PHI. Business Associate shall cooperate with NSMHA by providing 16 appropriate information to NSMHA to fulfill both parties’ responsibilities under 45 CFR, Section 164.528. 17 Business Associate agrees to provide an accounting of any disclosures of PHI for up to the six-year period 18 preceding the date of the request for an accounting. Such information shall include: 19 20 a. The date of the disclosure; 21 b. The name and address of the person or entity who received the PHI; 22 c. A brief description of the disclosed PHI; 23 d. A brief statement of the purpose of the disclosure including an explanation of the basis for such 24 disclosure; and 25 e. Such other information as may be required by applicable laws or regulations. 26 27 Business Associate must provide all such information to NSMHA on a timely basis not later than seven 28 (7) calendar days after NSMHA requests such information, unless otherwise specified by NHMSA. The 29 provisions of this section shall survive termination of this Agreement. 30

(b) Business Associate agrees to provide the Plan, in the time and manner set forth in the Plan's health information privacy policies and procedures, information collected in accordance with Section 12(a) above, to permit the Plan to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with Title 45, Section 164.528 of the CFR. It shall be Covered Entity’s responsibility to prepare and deliver any such accounting requested. Business Associate also agrees to comply with the requirements for disclosure of PHI from an EHR, as set out in §13405(c) of the HITECH Act and any regulations promulgated thereunder, as when applicable. Business Associate agrees to document such disclosures of PHI and information related to such disclosures as would be required for Covered Entity to respond to a request by an Individual for an accounting of disclosures. At a minimum, such information shall include: (i) the date of disclosure; (ii) the name of the entity or person who received PHI and, if known, the address of the entity or person; (iii) a brief description of the PHI disclosed; and (iv) a brief statement of the purpose of the disclosure that reasonably informs the individual of the basis for the disclosure, or a copy of the individuals’ authorization, or a copy of the written request for disclosure. The information also shall include any additional information required under §13405(c) of the HITECH Act and any regulations.

It shall be SCH’s responsibility to prepare and deliver any such accounting requested.
