ACDBE Goal. Authority encourages the inclusion of firms owned and controlled by minorities and women in contract awards and projects whenever feasible. This policy is consistent with the administrative mandate set out by the United States Department of Transportation Code of Federal Regulations in Title 49 Part 23 and Part 26. A participation goal of five percent (5%) was established for this project.

No specific goal for ACDBE participation has been established for this Agreement; however, Company agrees to make a good faith effort, in accordance with Authority’s ACDBE Program, throughout the Term of this Agreement, to contract with ACDBE firms certified under the Florida Unified Certification Program pursuant to 49 CFR Part 26 in the performance of this Agreement.
ACDBE Goal. The ACDBE goal for this Concession Agreement is initially 3.55%, as measured as a percentage of Concessionaire’s total annual Gross Revenue retained by the Concessionaire (defined as all Revenue collected by Concessionaire in the operation of the Parking Facilities, less any applicable sales or parking tax, credit card processing fees and less any Gross Revenue Percentage or Minimum Annual Guarantee payment). Concessionaire covenants that it shall make Good Faith Efforts (as defined in Part 23) to achieve this goal. ACDBE participation shall be counted toward this goal as provided in Part 23. Concessionaire agrees to submit information to the Board as required concerning the participation of certified ACDBE firms. Concessionaire’s failure to submit the required information or report to the Board on a timely basis shall result in a late fee of fifty dollars ($50.00) per day for each day late, unless otherwise approved by the Board. If Concessionaire cannot achieve the stated goal, it shall provide documentation to the Board that it has made Good Faith Efforts in attempting to achieve the goal.
ACDBE Goal. Concessionaire agrees that it will provide for a level of ACDBE participation in this Agreement equal to or greater than the percent of the total annual Gross Receipts stated on the Summary of Contract Provisions, or clearly demonstrate in a manner acceptable to City its good faith efforts to do so. Concessionaire will contract with the ACDBEs identified in Exhibit G presented with Concessionaire’s Proposal and approved by City, or such other ACDBEs certified with City’s DSBO as may be approved by City. Concessionaire is required to make good faith efforts to explore all available options to meet the goal to the maximum extent practicable.

The ACDBE goal for this Agreement is 14%, as measured as a percentage of Concessionaire’s total annual Gross Receipts. Concessionaire agrees to take all necessary and reasonable steps to achieve this goal. ACDBE Participation shall be counted toward this goal as provided in Part 23. Concessionaire agrees to submit quarterly reports to the Authority as required concerning the participation of certified ACDBE firms. If Concessionaire cannot achieve the stated goal, it shall provide documentation to the Authority that it has taken Good Faith Efforts, as defined in Part 23, in attempting to achieve the stated goal.
ACDBE Goal. ACDBE Participation. Lessee has committed to achievement of the fifteen percent (15%) ACDBE goal applicable to this Lease. Lessee plans to achieve this goal by entering into one or more subcontracts or subleases with ACDBE firms. In order to achieve the ACDBE goal, at least 15% of the Gross Receipts, as defined in Article 6, must be generated by ACDBE(s). Lessee shall ensure that every reasonable opportunity is offered to the ACDBE(s) to expand its role in this concession in appropriate areas. The following ACDBE requirements are applicable to this Lease:
1. The agreement(s) between Lessee and the ACDBE(s) must be submitted to the Authority for approval prior to execution. Lessee shall comply with the terms of that agreement(s) and a copy of that agreement shall be attached to this Lease as Exhibit D.
2. The fifteen percent (15%) ACDBE goal is applicable to this Lease at all times during the Term of the Lease.
3. If Lessee determines that a change in the ACDBE firm(s) is necessary for legitimate business reasons, other than a termination for cause, a request to substitute another ACDBE firm(s) must be submitted to the Authority for approval by the Authority's Equal Opportunity Programs Office. If the Authority determines that such a substitution of the ACDBE firm(s) is not justified, the Authority may disapprove the substitution. In the event of disapproval, Lessee is required to continue to maintain the existing ACDBE participation. If the substitution is approved, Lessee shall replace the existing ACDBE with another ACDBE that has been reviewed, certified and approved by the Authority's Equal Opportunity Programs Office. Such ACDBE shall participate at least to the same extent as the previous ACDBE participant. Lessee shall monitor the certification status of any and all ACDBE firms included in this Lease to insure that their status as certified ACDBEs remains current

Concessionaire agrees to submit annual reports to the Authority as required concerning the participation of certified ACDBE firms. If Concessionaire cannot achieve the stated goal, it shall provide documentation to the Authority that it has taken Good Faith Efforts, as defined in Part 26, in attempting to achieve the stated goal (see Appendix “A”).
ACDBE Goal. The City encourages the inclusion of firms owned and controlled by minorities and women in contract awards and projects whenever feasible. This policy is consistent with the administrative mandate set out by the United States Department of Transportation Code of Federal Regulations in Title 49, Part 23 and Part 26. The City intends to meet or exceed the goals applicable to concessions other than car rentals set forth in 49 CFR 23.41, et seq, or make good faith efforts to do so. Concessionaire agrees to submit quarterly reports to the City as required concerning the participation of certified ACDBE firms.

Concessionaire agrees that it will provide for a level of ACDBE participation in this Agreement equal to or greater than {insert amount stated in Concessionaire’s Response} [ ] percent ( _ %) of the total annual Gross Receipts, or clearly demonstrate in a manner acceptable to City its good faith efforts to do so. Concessionaire will Contract with those ACDBEs as identified in Exhibit G for each ACDBE presented with Concessionaire’s Response and approved by City, or such other ACDBEs certified with City’s DSBO as may be approved by City. Concessionaire is required to make good faith efforts to explore all available options to meet the goal to the maximum extent practicable through direct ownership arrangements with ACDBEs. Concessionaire shall not take any action during the term of this Agreement that may have a materially negative impact upon the Concessionaire’s ability to meet its stated ACDBE goal.
