Additional Service Areas. Except for the Service Area, Franchisee shall not be required to extend its Cable System or to provide Cable Services to any other areas within the Franchise Area during the term of this Franchise or any Renewals thereof. If Franchisee desires to add Additional Service Areas within the Franchise Area, Franchisee shall notify LFA in writing of such Additional Service Area at least ten (10) days prior to providing Cable Services in such areas.
Additional Service Areas. In the event that Franchisee desires to build-out the cable system beyond the franchise area, Franchisee shall notify LFA in writing and provide detailed plans and maps of the desired build-out. LFA and franchisee shall then negotiate in good faith the timeframe and terms of the build-out of such additional areas meeting the requirements of a Secondary Franchise.
Additional Service Areas. Aside from the Initial Service Area and the Extended Service Area, Franchisee shall not be required to extend its Cable System or to provide Cable Services to any other areas within the County during the term of this Franchise. If Franchisee desires to add additional service areas within the Franchise Area, Franchisee shall notify the County in writing of such additional service area at least ten (10) days prior to providing Cable Services in such areas.
Additional Service Areas. Except for the Initial Service Area, Franchisee shall not be required to extend its Cable System or to provide Cable Services to any other areas within the Franchise Area during the term of this Franchise or any Renewals thereof except as set forth in this Section 3.1.3. The parties agree that if any land is annexed by the LFA during the term of this Agreement, such annexed areas shall become part of the Franchise Area and Franchisee shall be required to extend Cable Service within a reasonable time to such annexed area (subject to the exceptions in Section 3.1.1 above), provided that such annexed area:
(a) is contiguous to the LFA, (b) is within Franchisee’s Title II service territory, and (c) is served by the video-enabled FTTP Network. If Franchisee intends to serve Additional Service Areas within the Franchise Area, Franchisee shall notify the LFA in writing of such Additional Service Area at least ten (10) days prior to providing Cable Services in such areas.
Additional Service Areas. Subject to Sections 3.3 and 3.5, to the extent that the Franchise Area is expanded beyond the Service Area whether by annexation or any other lawful means by the City to (i) an area in which the Franchisee is providing Cable Service, (ii) an area in which the Franchisee is legally obligated to provide Cable Service, or (iii) an area that is served out of the same wire center(s) that provide(s) cable service to the City in Section 3.1 (the “Additional Service Areas”), the Franchisee shall make Cable Service available in such Additional Service Areas within one (1) year of annexation by the City. Should, through new construction, an area within any Additional Service Area subsequently meet the density requirements set forth in this Subsection, the Franchisee shall provide Cable Service to such area within six (6) months of receiving notice that the density requirements have been met. Any such Additional Service Areas in which Franchisee is required to make Cable Services available by operation of this Subsection shall be deemed to be portions of the Service Area for purposes of this Agreement.

Service Areas Outside Lee County: No This plan will analyze transportation issues on Sanibel including accessibility, climate-based risks and system vulnerabilities, traffic congestion, demand, safety, connectivity, parking and transportation alternatives; and will assess implementation of intersection and roadway design, parking policy and infrastructure, and traffic operations management to improve level of service along Sanibel’s major roadways. Most importantly, this activity will plan for critical infrastructure improvements, such as elevating roadways and associated utility infrastructure, for protection against climate-based risks (i.e., sea level rise).

This extensive revision is meant to update the plan comprehensively for the first time since 2013, including evaluation of the current Sanibel Plan and amendments that reflect City Council strategic goals of Affordable Housing and Adaptation Planning, as well as input of the community, to provide long-range planning goals, objectives and policies for a ten-year period, through 2035.
