ASSESSMENTS AND RESPONSE ACTIONS. This section describes the internal and external checks necessary to ensure that all elements of the QAPP are implemented correctly as prescribed, that the quality of the data generated by implementation of the QAPP is adequate, and that any necessary corrective actions are implemented in a timely manner.
ASSESSMENTS AND RESPONSE ACTIONS. The Field Team Leader in consultation with the Project Manager will be responsible for corrective actions related to field activities. Corrective measures will be thoroughly documented in field logs. If there appears to be a problem that could adversely affect data quality, the Field Variance Decision Tree provided in Section B-2 was developed with respect to the Project Organizational Chart in Section A-4.2, to provide a clear picture of the response process for field variances. This section lists and describes the oversight activities to be conducted on the City of Shreveport’s Xxxxxxxxxx Project to meet the City’s data needs in rendering a decision associated with site cleanup activities.

The Project QA Officer will conduct systematic reviews of the data for the specified DQOs every time data packets are delivered and entered into the SCCWRP database. Any problems will be relayed to the Project Director. The SCCWRP QA Officer has the power to halt all sampling and analytical work by the MLML lab or SCCWRP if the deviation(s) noted are considered detrimental to data quality. Problems that cannot be corrected, will be documented by the QA Officer, flagged in the database, and acknowledged in the final report.

The following sections describe the procedures for possible assessment and response actions. ASSESSMENTS AND RESPONSE ACTIONS. Project data will be reviewed, as discussed below, by the project QAE as it is generated and/or received from the contract laboratory. Data reviews will be designed to ensure that methods used in both the field and the laboratory are compliant with the applicable SOP, SAP, and/or QAPP (as appropriately altered by authorized field changes), meet the project DQOs, and exhibit variation within acceptable criteria, as described in Section 5.1. In addition, CLP-Type data packages will be requested from the laboratory, to allow for later validation of the data to suit alternative DQOs or end-uses. All analytical data will be provided to the Shpack Steering Committee for their use. In cases where deviation from the above criteria is identified, corrective action will be initiated by the QAE, who will detail the deviation(s) in a report to the Senior Project Manager. The Senior Project Manager, in concert with the SRE, will determine appropriate corrective action and will ensure such action is completed. The magnitude of corrective action will be commensurate with the magnitude of the deviation.

  • Notice and Reports The request for the issuance of a Letter of Credit shall be submitted to the Issuing Lender at least five (5) Business Days prior to the requested date of issuance.   • Agreements; Actions (a) Except for the Transaction Agreements, there are no agreements, understandings, instruments, contracts or proposed transactions to which the Company is a party or by which it is bound that involve (i) obligations (contingent or otherwise) of, or payments to, the Company in excess of RMB100 million (ii) the license of any patent, copyright, trademark, trade secret or other proprietary right to or from the Company, (iii) the grant of rights to manufacture, produce, assemble, license, market, or sell its products to any other Person that limit the Company’s exclusive right to develop, manufacture, assemble, distribute, market or sell its products, or (iv) indemnification by the Company with respect to infringements of proprietary rights. (b) The Company has not (i) declared or paid any dividends, or authorized or made any distribution upon or with respect to any class or series of its capital stock, (ii) incurred any indebtedness for money borrowed or incurred any other liabilities individually in excess of RMB100 million or in excess of RMB200 million in the aggregate, (iii) made any loans or advances to any Person, other than ordinary advances for travel expenses, or (iv) sold, exchanged or otherwise disposed of any of its assets or rights, other than the sale of its inventory in the ordinary course of business. For the purposes of (a) and (b) of this Subsection 2.5, all indebtedness, liabilities, agreements, understandings, instruments, contracts and proposed transactions involving the same Person (including Persons the Company has reason to believe are affiliated with each other) shall be aggregated for the purpose of meeting the individual minimum dollar amounts of such subsection. (c) The Company is not a guarantor or indemnitor of any indebtedness of any other Person.

  • Payments and Reports All payments and reports due hereunder shall be made on or before the day such payments and reports are due. Nothing in this paragraph shall be construed to extend the expiration of the primary term hereof. Oil royalty payments and supporting documents shall be submitted prior to the last day of the month following each month's sale of production, and gas royalty payments and supporting documents shall be submitted prior to the last day of the second month following each month's sale of production. All payments shall be made by cash, check, certified check, or money order. Payment having restrictions, qualifications, or encumbrances of any kind whatsoever shall not be accepted by Lessor. A penalty for a late payment shall be charged as set forth in the PENALTIES paragraph herein.

  • Studies and Reports All copies in the Seller’s possession of studies and/or reports which have previously been performed in connection with or for the Property, including without limitation, environmental reports, soils studies, seismic studies, physical inspection reports, site plans and surveys, and identification of such studies of which the Seller is aware but that are not in their possession;

(b) Except as set forth in Section 4.27(b) of the Disclosure Schedule, since February 19, 2008, neither the Company nor any of its Subsidiaries has received any notice, report, order, or directive regarding any, and is not subject to any litigation, proceedings or order regarding any, actual or alleged violation of Environmental and Safety Requirements, or any liability or potential liability arising under Environmental and Safety Requirements, in effect prior to and as of the date of the applicable Closing, relating to the business, the Owned Real Property or Leased Real Property. (c) Except as set forth in Section 4.27(c) of the Disclosure Schedule, neither the Company nor any of its Subsidiaries has treated, stored, disposed of, arranged for or permitted the disposal of, transported, handled, released, or exposed any Person to, any substance (including without limitation any hazardous substance), owned or operated any property or facility which is or has been contaminated by any substance, so as to give rise to any current or future liabilities under any Environmental and Safety Requirements in effect at the time of such treatment, storage, disposal, transportation, handling, release or exposure. (d) Except as set forth in Section 4.27(d) of the Disclosure Schedule, neither the Company nor any of its Subsidiaries has assumed, undertaken, or provided any indemnity with respect to, any liability of any other Person relating to Environmental and Safety Requirements. (e) The Company has furnished to Investor true and correct copies of all environmental audits, reports, assessments and all other documents materially bearing on environmental, health or safety liabilities relating to the past or current operations or facilities of the Company and all of its Subsidiaries, in each case which are in its possession or under its reasonable control.
