ASSOCIATION SECURITY. A. All teachers employed To the extent that the laws of the State of Michigan permit, it is agreed that: 2.01 Each employee who, on the effective date of this Agreement, is a member of the Association and has authorized dues deductions will do so with the understanding that the deductions will continue for the length of the Agreement. 2.02 Present members, members hired, re-hired, reinstated, or transferred into the Bargaining Unit after the effective date of this Agreement and covered by the Boardthis Agreement will be required, as a condition of continued employment, shall to become members of the Association or pay a service fee (not including initiation fees, reinstatement fees, assessment, fines, penalties, etc.) up to but not to exceed the amount equal to the monthly dues on or before the 30th working day after the beginning of their employment in the unit or before the l0th working day following the 30th work day following the effective date of this Agreement. The Human Resources Department will provide the names of new employees with their appropriate information to the Association. 2.03 During the term of this Agreement, any member in the Bargaining Unit who is not an Association member and does not make application for membership will, as a condition of employment, on or before the 30th working day after their probationary period, pay to the Association a service charge (not including initiation fees, reinstatement fees, assessments, fines, penalties, etc.) up to but not to exceed the amount equal to the monthly dues as a service fee. Employees who fail to comply with this requirement will be subject to discharge by the Board. 2.04 In the event a regular, full-time, or part-time member does not join the Association either directly or through a voluntary deduction authorization or service charge as indicated above, such member will be terminated, provided the Association has complied with the following: A. Fulfillment of the requirements of Section 2.07 of this Article. B. Fulfillment of its fiduciary obligations by sending written notice to the member that she/he has an obligation to tender dues or service fee (not including initiation fees, reinstatement fees, assessments, fines, penalties, etc.), the reasonable date for such obligation, the amount of such tender, and to whom tender is to be made. A copy of such notice must be sent to the Board. C. Fulfillment of its responsibilities by sending written notice to the member (copy to the Board) that the member has not fulfilled their obligation by the requisite date or reasonable period of time thereafter, and that a request for their termination is being made to the Board. D. By stating in the request for termination that such request is in conformance with the provisions of this Article, that the member has not complied with their obligations, that it is an official demand of the Association to request the discharge of said member and that the "save harmless" clause set forth in Section 2.06 below will be put into effect. E. Providing the Association has furnished the Board with written proof that the foregoing procedure has been followed or has supplied the Board with a copy of the notice to the member and notice that the member has not complied with such request, the Association must further specify the following by written notice when requesting the Board to discharge the member. "The Association herewith certified that the following named member is not in good standing with the Association because of his/her failure to tender or pay the periodic dues uniformly required as a condition of acquiring and/or retaining membership in this Association or service fee (as stated above). The suspension from good standing of the named member occurred under a uniformly applied suspension policy of the Association." 2.05 Employees will be deemed to be members of the Association, within the meaning of this Section, if they are not more than sixty (60) days in arrears in payment of membership dues. Members will be required to pay dues or service fee for the months worked up to 10 months per fiscal year as determined by the Association. 2.06 The Association agrees it will protect, indemnify, and save the Board harmless against any and all claims, demands, costs, suits, and other forms of liability that may arise out of, or by reason of, action taken or not taken by the Board for the purposes of complying with this Article. 2.07 The interpretation, application, administration, and enforcement of the Association Security Article will be in accordance with the requirements of the Public Employment Relations Act 379 of 1965, as amended, and to the extent that it does not conflict with any federal or state laws. 2.08 The Parties recognize that any member may exercise his/her choice to either to join the Association or pay a service fee to the Association. Such committee shall represent the Association in all negotiations with the representatives of the Board for a renewal of this Agreement. 6.02 Members of the bargaining unit committee who attend negotiation meetings with the Board at times when they would otherwise be performing occasional teaching duties for the Board, or would otherwise be available to be called in for occasional teaching duties, shall be entitled to receive the appropriate daily rate for Occasional Teachers for each day spent attending such meetings. The payment shall apply only to meetings held between 9:00 AM and 3:30 PM on school days. If such meetings last for only one half (l/2) day or less, the member shall be paid for the full day. (a) The Board's Occasional Teachers’ Roster shall mean the total of any sub-lists kept by the Board that includes Occasional Teachers on Long Term Assignments List (shall include the name of the school year. ASSOCIATION SECURITY. A. It is understood that the selection of the attorney shall be the exclusive rights of the Association and all proceedings shall be under the control of the Association. ASSOCIATION SECURITY. A. All teachers employed by Membership in the BoardAssociation is not compulsory. However, during the term of this Agreement, and in accordance with and to the extent of any applicable state or federal laws, every librarian shall, as a condition of continued employmentemployment by the Employer, shall join either become a member of the Association or pay and tender thereafter the uniformly required Association membership dues or, in the alternative, tender a service fee in an amount no greater than the uniformly required Association membership dues. The membership dues or service fees shall be tendered commencing with the first pay period following the librarian’s completion of thirty (30) calendar days of service with the Employer or thirty (30) calendar days after the execution of this Agreement, whichever is later. B. The amounts to be tendered for service fees and Association local, state and national dues amounts shall be determined by the Association and reported to the Employer on or before August 15th of each year. C. The Employer shall deduct membership dues and service fees on a biweekly basis for those librarians who have submitted a properly executed Payroll Deduction Authorization form to the Employer. Any Payroll Deduction Authorization form which is incomplete or in error will be sent to the Treasurer of the Association by the Employer. D. Deductions shall be made only in accordance with the provisions of the librarian’s Payroll Deduction Authorization form, together with the provisions of this Agreement. The Employer shall have no responsibility for the collection of membership dues and special assessments, or any other deductions not in accordance with the express provisions of this Article. Further, the Employer shall have no obligation to make deductions from the pay of any librarian who has insufficient net earnings due him/her to cover the full amount of such deductions. E. Membership dues and service fee deductions shall be direct deposited into the Association’s bank account each pay period. The Employer shall provide to the Treasurer of the Association an itemized list of individual librarian deductions within ten (10) working days after the end of each month to the address furnished in writing to the Employer’s Payroll Office by the Association. This service fee The Association assumes full responsibility for the disposition of all monies deducted once they have been forwarded to the Association as set forth above. F. Authorization forms may be revoked by providing written notice to the Employer of said revocation. Said notice must be sent to the Employer by certified mail. Librarians shall cease to be subject to deduction following the pay period in which the librarians’ employment in the Bargaining Unit terminates. The Association shall be set notified by the Association, but shall not exceed Employer of the proportional cost attributable to collective bargaining, grievance adjustment and contract administrationnames of such librarians following the end of the pay period in which the termination occurs. In cases where a deduction is made that duplicates a payment that a librarian already has made to the Association, if they have or where a deduction is not already done so, an authorization for payroll deduction of membership dues in conformity with the provisions of the Association. This authorization shall continue in effect from year ’s Constitution or Bylaws, or this Agreement, refunds to year unless the teacher notifies the Board and the Association in writing in August of any year that the teacher no longer authorizes deduction of membership dues of the Association. If this notice is timely delivered, it shall mean that in the coming school year the teacher shall pay the service fee as described in the above Section A via payroll deduction. C. For those teachers who have not delivered an authorization card by October 1 of the first year of this contract, the Board agrees to deduct the annual service fee, as set librarian will be made by the Association. H. The Employer shall not be liable to the Association by reason of the requirements of this Agreement for the remittance or payment of any sum other than that constituting actual deductions made from wages earned by the librarian. Librarians in the Bargaining Unit who fail to tender to the Association either periodic and uniformly required Association dues or, from their salaries via payroll deductionin the alternative, service fees as above established, shall be terminated by the Employer, provided the following stipulations are adhered to: 1. The Association shall notify the librarian by certified or registered mail explaining that he or she is delinquent in not tendering required Association dues or service fees, specifying the current amount of this the delinquency, the period of delinquency and warning the librarian that unless delinquent dues or service fee fees are tendered within thirty (30) calendar days of such notice, the librarian shall be certified reported to the Employer for termination as provided for in this Article. 2. The Association shall give a copy of the letter sent to the librarian and the following written notice to the Employer’s Payroll Manager, or his/her designee, at the end of the periods referenced in Section (1) above. The Association certifies that has failed to tender either the periodic and uniformly required Association dues or service fees required as a condition of continued employment under the Collective Bargaining Agreement and demands that, under the terms of this Agreement, the Employer terminate this librarian. A copy of such notice shall, at the same time, be given by the Association to the Board prior librarian. 3. Upon receipt of such notice the Payroll Manager, or his or her designee, shall communicate the Association’s request for termination to the opening of librarian and advise such librarian that he or she must pay all back dues or service fees owed the school year. D. Those teachers commencing employment after the start of the school year shallAssociation, within thirty (30) days of receipt of such commencement, sign and deliver notice to the Board an authorization card as described in Section B, Employer (unless otherwise extended by the Association and the Employer) or be subject to Section C after such thirty (30) days. The amount of dues he or service fee under this section she shall be a prorated amount to the percentage of the remaining school yearterminated. E. No later than the first paycheck in October of each year, the Board shall provide the Association with a list of all certified employees, below the rank of assistant principal, employed by the Board. The Board shall notify the Association monthly of any changes in this list. F. J. The Association agrees to indemnify shall protect and hold save harmless the Board harmless against Employer from any or and all claims, costs, fees, demands, suits, or suits and other forms or of liability that shall or may arise out of or by reason of action taken or not taken by the Board Employer for the purpose of complying with this Article. If the Employer wishes to obtain its own representation it may do so at the cost of the Employer. K. ASSOCIATION SECURITY. A. All teachers employed by Membership in the BoardAssociation is not compulsory. However, during the term of this Agreement, and in accordance with and to the extent of any applicable state or federal laws, every employee shall, as a condition of continued employmentemployment by the Employer, shall join either become a member of the Association or pay and tender thereafter the uniformly required Association membership dues or, in the alternative, tender a service fee in an amount no greater than the uniformly required Association membership dues. The membership dues or service fees shall be tendered commencing with the first pay period following the employee’s completion of thirty (30) calendar days of service with the Employer or thirty (30) calendar days after the execution of this Agreement, whichever is later. B. The amounts to be tendered for service fees and Association local, state and national dues amounts shall be determined by the Association and reported to the Employer on or before August 15th of each year. C. The Employer shall deduct membership dues and service fees on a biweekly basis for those employees who have submitted a properly executed Payroll Deduction Authorization form to the Employer. Any Payroll Deduction Authorization form which is incomplete or in error will be sent to the Treasurer of the Association by the Employer. D. Deductions shall be made only in accordance with the provisions of the employee’s Payroll Deduction Authorization form, together with the provisions of this Agreement. The Employer shall have no responsibility for the collection of membership dues and special assessments, or any other deductions not in accordance with the express provisions of this Article. Further, the Employer shall have no obligation to make deductions from the pay of any employee who has insufficient net earnings due him/her to cover the full amount of such deductions. E. Membership dues and service fee deductions shall be direct deposited into the Association’s bank account each pay period. The Employer shall provide to the Treasurer of the Association an itemized list of individual employee deductions within ten (10) working days after the end of each month to the address furnished in writing to the Employer’s Payroll Office by the Association. Authorization forms may be revoked by providing written notice to the Employer of said revocation. Said notice must be sent to the Employer by certified mail.
