Authority GrantedIn the case of any appointment of a co-trustee or separate trustee pursuant to this Section 8.09, all rights, powers, duties and obligations conferred or imposed upon the Trustee will be conferred or imposed upon, and exercised or performed by the Trustee and such separate trustee or co-trustee jointly, except to the extent that under any law of any jurisdiction in which any particular act is to be performed, the Trustee is incompetent or unqualified to perform such act, in which event such rights, powers, duties and obligations (including the holding of title to all or any part of the related Trust Fund in any such jurisdiction) will be exercised and performed by that separate trustee or co-trustee at the direction of the Trustee.
Authority Granted. City hereby grants Collector limited and non-exclusive authority and franchise to engage, as a Collector in the business of collecting, removing, transporting and disposing of Non-putrescible Solid Waste and/or Construction and Demolition Debris produced, kept or accumulated in the City subject to and in accordance with the provisions of this Agreement and the BFI-Waste Systems of North America Franchise as follows: On a non-exclusive basis, to service only those commercial establishments or residential customers who elect to use Collector and who can provide written certification, under penalty of perjury, that said establishment or customer uses the following: (a) Commercial temporary Debris Boxes at construction sites for collection of Construction and Demolition Debris from commencement to completion of construction including new construction and/or remodeling, renovating, rehabilitating, or demolition of existing structures and contents (see Section Five of BFI agreement). (b) Residential temporary Debris Boxes that shall not be located thereon for more than thirty (30) days within any sixty (60) day period and shall not be located on a public right-of-way, unless and until the owner or occupant of the Premises secures written consent from the City (see Section Five of BFI agreement). (c) Non-containerized hauling services, including but not limited to landscapers, tree services, and bulky item haulers. (d) Collection of recyclables from commercial premises, so long as (i) the transaction does not result in a payment or other consideration to the hauler of the recyclable materials, and if (ii) the customer subscribes to solid waste service for the balance of its solid waste pursuant to the City and BFI’s agreement and the Milpitas Municipal Code (MMC) V-200. (e) Collection of tallow and restaurant grease. (f) Collection of Yard Trimmings for Recycling from multi-family, mobile home parks, and non-residential sites. (g) Collection of cardboard, mixed paper, scrap metal, polystyrene, clean wood, wood pallets and circuit boards, so long as the customer subscribes to solid waste service for the balance of its solid waste pursuant to the Allied agreement and MMC V-200; the recyclables listed above are separated and stored for collection by material type; the recyclables contain no residual materials; the recyclables are processed for beneficial reuse and are not disposed of in a landfill; and, the recycler maintains required City permits and licenses.

Authority GrantedThe City hereby grants to Franchisee, subject to the terms and conditions contained in this Agreement, the right, privilege and authority to utilize City’s Public Ways for construction and operation of its Communications System and to acquire, construct, operate, maintain, replace, use, install, remove, repair, reconstruct, inspect, sell, lease, transfer, or to otherwise utilize in any lawful manner, all necessary equipment and facilities thereto for its Communications System, and to provide Communications Service.
Authority Granted. Owner hereby grants the Port and it’s agents and employees free access at all times to the vessel for purposes of inspection for compliance with this agreement, movement of the vessel pursuant to paragraph 12, fighting of fire or other casualty or, in the discretion of the Port, preventing any casualty or potential hazard. However, as provided in paragraph #5, the Port does not assume any responsibility for the vessel on the basis of the foregoing rights.
Authority Granted. Owner hereby exclusively appoints Agent and grants full actual authority with Limited Power of Attorney in the management, leasing, operating, and Provision Property Management 000-000-0000 000 Xxxxxxx Xxx. Suite 206. Severna Park, MD 21146 arranging for the Property, and to do all lawful things necessary for the fulfillment of this Agreement.
Authority Granted. A. Investor has granted to the person executing this Agreement on its behalf the authority to do so and hereby consents to all of its terms.
Authority GrantedThe Mayor is hereby authorized and directed to execute the Second Amended Lease in substantially the same form as that attached hereto and incorporated herein as Exhibit A, between the City and the Tenant, and the Mayor, City Administrator, Special Counsel to the City - Xxxxxxx Xxxx LLP, and other appropriate officials and employees of the City are hereby authorized and directed to take such further action related thereto as is otherwise necessary or desirable to carry out and comply with the intent of this Ordinance.

The company is hereby granted the right, authority and privilege to construct and install, operate, maintain, lay or relay, renew, replace and repair gas pipes, mains, pipelines, conduits, regulators, connections and services thereto, in, through, across, along and under streets, avenues, roads, public alleys, lanes, parks and squares, and other public places and ways in the town for the production, pumping, handling, transmission, distribution and sale of gas for any and all purposes, subject to the terms and conditions hereinafter set forth in this ordinance.
