Section Five. In the event the Commissioner of Administrative Services or designee disapproves the requested assignment on the basis of his/her judgment that the assignment does not constitute temporary service in a higher class, the employee shall continue working as assigned with recourse under the appeal procedure for reclassification but not under the grievance and arbitration procedure. The form certifying the assignment will specify the rights and obligations of the parties under Sections Four and Five.
Section Five. If the position has a clinical leadership or service management role, this section should contain an agreed description of those duties.
Section Five. When an employee seeks access to his personnel file, the employer shall provide time off, charged as work time to travel to the Agency Office to examine the file or have the file or copies of its contents transferred to the Employee’s work site for inspection in accordance with Section Two.

In lieu of layoff, an employee with more than two (2) years of continuous State service may bump into a lower class within the same classification series or a class declared comparable within the agency in which the layoff occurs, and shall bump the employee with the lowest bargaining unit seniority in such lower class subject to the provision of Section Two.
Section Five. The Employer will provide security for employees who continue to meet job obligations in spite of any illegal strike, picket line or other job action posing a hazard to the employees' safety.
Section Five. The State will waive the Working Test Period for trainees and pre-professional trainees who satisfactorily complete two (2) year training programs. For trainees and pre-professional trainees with program duration of less than two
Section Five. Neither party shall discriminate against any employee on the basis of membership or non-membership or lawful activity on behalf of the exclusive bargaining agent.
Section Five. Professional leave is defined as leave to attend seminars, classes, lectures, workshops, conventions, or other related activities in aid of the development, maintenance or exchange of professional skills, techniques or experiences which clearly relate to an employee's primary job assignment or logical career progression.
Section Five. Firefighters who have not been issued dress uniforms by the State, and who chose to purchase such a uniform shall be entitled to reimbursement of 70% of the cost of said purchase, provided that no employee shall be entitled to more than $130. The employee must submit a receipt of purchase in order to receive reimbursement.
