Authority of Broker. 39 Owner authorizes Xxxxxx to perform the services selected below or described elsewhere in this Agreement: 40 Collect all rents and additional charges (such as late fees, bounced check fees) from tenants when such amounts become due 41 Collect and account for security deposits in accordance with applicable law 42 Draw from the management account to pay all compensation due to Broker under this Agreement (see Broker Fees paragraph) 43 Draw from the management account to pay utilities and expenses on behalf of Owner (see Utilities and Expenses paragraph) 44 write and amend leases on behalf of Owner 45 Renew leases on behalf of Owner 46 Execute and terminate leases on behalf of Owner 47 Negotiate and settle disputes with tenant 48 Institute legal proceedings and carry out eviction proceedings against a tenant before a magisterial district justice (see Legal paragraph) 49 Make inspections of the Property Broker feels necessary and report the condition of the Property to the Owner 50 Contract for the performance of maintenance (see Maintenance paragraph) 51 Turn utilities on and off (see Utilities and Expenses paragraph) 52 Keep and use lock boxes; copy, hold and distribute keys; and change locks 53 Screen, approve and deny potential tenants 54 Other 55 Broker/Licensee Initials: / PMA Page 1 of 5 Owner Initials: / Revised 7/13 COPYRIGHT PENNSYLVANIA ASSOCIATION OF REALTORS® 2013 56 5. MAINTENANCE 57 (A) If elected in Paragraph 4, Broker may, at Owner’s expense, hire contractors to perform any maintenance (upkeep, repairs and ren- 58 ovations) that Broker deems necessary to preserve the Property in its present operating condition, comply with lease requirements, 59 governmental regulations and/or insurance requirements. Broker may only contract for the performance of maintenance up to 60 $ ($250 if not specified) per single instance without prior permission from Owner. Instances costing more than the 61 amount in this paragraph must have prior approval by Owner.
(B) In the case of an emergency, Broker may, at Owner’s expense, perform maintenance without prior approval, even if it exceeds the 63 dollar amount in paragraph 5(A). An emergency is an action required to be taken immediately to avoid the suspension of any 64 essential service to the Property, or to avoid, eliminate or remedy a risk of serious bodily harm to an individual lawfully on the 65 Property. 66 (C) Broker will make available to Owner documentation for any maintenance that is performed.
Authority of Broker. A. Leasing and Management Authority: Owner grants to Broker the following authority which Broker may exercise when Broker determines to be in Owner’s best interest:
1. Advertise the Property for lease using methods Broker determines to be most effective;
Authority of Broker. Xxxxxx is hereby appointed as PHP's broker, and Broker is authorized:
1. To solicit employer or other groups to purchase Welfare Benefit Contracts under this Agreement.
2. To solicit individuals to purchase individual Welfare Benefit Contracts under this Agreement.
3. To collect initial premium payments or other monies under Welfare Benefit Contracts.
4. To designate and appoint agents and employees who will act on behalf of Xxxxxx to discharge the Broker's obligations under this Agreement. Such agents and employees designated by Broker shall be the agents and employees of Broker.
Authority of Broker. Broker is and shall at all times act as an independent contractor, and as such shall have no authority to incur any obligation on behalf of CHB; to make any statements or representations on behalf of CHB; to bind or commit CHB to any Transaction; nor to make, alter, or make any document on behalf of CHB. Broker shall not represent to any party that Broker is employed by or represents or acts as an agent of CHB. Broker is an independent contractor and no partnership, agency, joint venture or any similar relationship with CHB exists or is contemplated.
Authority of Broker. X. Xxxxxxx and Management Authority: Owner grants to Broker sole and exclusive rights for the Property and the following authority which Broker may exercise when Broker determines to be in Owner’s best interest:
1. Negotiate, prepare and execute all leases, including all renewals and extensions of leases and to cancel and modify existing leases for the Property on behalf of Owner;
2. To pay all expenses as hereinafter provided to the extent funds are available;
3. Market and Advertise the Property for lease using methods Broker determines to be most effective including specials and giveaways;
4. Market of the Property by signage, print, internet or website;
5. Any advertising specifically requested by Owner will be at Owners expense;
Authority of Broker. Section II
Authority of Broker. Broker shall have no authority to bind Landlord, but shall attempt to negotiate basic business terms for leases that benefit Landlord, considering market conditions for the Property, and that are acceptable to Landlord staff. Broker shall make clear to Prospective Tenants (and their brokers, if any) that Landlord will not be bound unless and until its City Council approves the applicable lease in its sole and absolute discretion.
Authority of Broker. Broker represents and warrants that it has the authority to contract on behalf of and bind the individual brokers employed by Broker. Broker shall cause individual brokers employed by it to comply with all the terms of this Agreement. Broker shall solicit enrollment of Enrolling Units under this Agreement. Plans may from time to time adjust the minimum Enrolling Unit Size it will accept for enrollment. Any such adjustment shall be communicated to Broker on a timely basis.
Authority of Broker. Broker is and shall at all times act as an independent contractor and as such shall have no authority to incur any obligation on behalf of TCS; to make any statements or representations on behalf of TCS; to bind or commit TCS to any transaction; nor to make, alter, or execute any document or agreement on behalf of TCS. Broker shall not represent to any party that Broker is employed by or represents or acts as an agent for TCS. Broker is an independent contractor and no partnership, agency, joint venture or any other similar relationship with TCS exists or is contemplated. Broker shall not accept service of any legal process in any action which may be brought against TCS.
