AUTOMATIC REPLENISHMENT. After having received a written request from the purchaser for “automatic replenishment” the Contractor will comply at its option and shall notify agency accordingly.

AUTOMATIC REPLENISHMENT. You may elect to have your Account automatically replenished by credit or debit card when your Account balance reaches the Low Balance Threshold Amount (see Attachment A). The Replenishment Amount will depend on the Account type and number of transponders registered to the Account in accordance with Attachment A. If your minimum use is consistently different than the Initial Replenishment Amount (based on your use of the Peach Pass over a rolling three month period), then the Replenishment Amount may, without further notice, increase or decrease to more accurately reflect your average monthly usage. Depending on your usage or other charges to your Account, there may be more than one replenishment transaction in any given month. It is your responsibility to immediately update the Account anytime your credit or debit card expires or otherwise fails to replenish. Failure to do so will result in a Toll Violation if you use a Toll Facility and there are insufficient funds in your Account.
AUTOMATIC REPLENISHMENT. Requests for automatic replenishment are preferred in WRITING from an Authorized User, but may be required by the Contractor. A Contractor shall provide written notification back to any Authorized User's request for automatic replenishment on any tank with a total gross capacity equal to or greater than 500 gallons. Automatic replenishment for tank capacities less than 500 gallons will be at the Contractor’s option and may be subject to a minimum order charge (see Minimum Order clause). Determination for total gross tank capacity shall include all manifolded tanks. The Contractor shall maintain a record of the estimated consumption of ULS diesel and biodiesel, and shall replenish the Authorized User’s tank or tanks without further notice from the Authorized User, whenever necessary to ensure an adequate supply at all times. If the Contractor, after having accepted the request from the Authorized User, permits the level of the fuel to fall below the percentages of the total capacity of the Authorized User’s tank or tanks indicated in the following table, and does not meet the requirement to deliver on an emergency basis within four (4) hours, the Authorized User shall have the right to purchase sufficient fuel on the open market from another vendor to fill such tank or tanks, and to charge any increase in price paid over the current contract price to the account of the Contractor.
AUTOMATIC REPLENISHMENT. You may elect to have your Account automatically replenished by your credit card, debit card, or ACH when your Account balance reaches the Low Balance Threshold amount (see Attachment A) using TxTag’s AutoPay program. Accounts on AutoPay will be analyzed periodically for toll usage, and the automatic replenishment amount may be adjusted based on increased usage. The frequency of replenishment transactions will depend on toll road usage and other charges to your Account.

After having received and accepted the WRITTEN request from the purchaser for “automatic replenishment”, if the Contractor permits the level of the fuel oil to fall below the percentages of the total capacity of the purchaser’s tank or tanks indicated in the following table, the purchaser shall have the right to purchase sufficient fuel oil on the open market to fill such tank or tanks and to charge any increase in price paid over the current Contract price to the account of the Contractor. The minimum order size of 500 gallons stipulated in Section 2.23 Minimum Order shall not apply to deliveries being made to Authorized Users on an automatic delivery schedule as the contractor controls the frequency, delivery dates, and quantities of the deliveries being made.
