Bid Opening and Award of Contract. Subdivider shall open bids and award contracts in accordance with all the Required Contracting Procedures. Subdivider shall work with City’s Purchasing and Contracting Department to ensure that bids are opened and contracts are awarded in the manner required in accordance with the Required Contracting Procedures. Subdivider shall publicly open sealed bids in the presence of City’s authorized representative(s). The bidding contractors shall be permitted to be present at the bid opening. City’s representative(s) shall be provided with all bids received immediately after the bid opening and with a copy of the tabulation of bid results upon Subdivider’s completion. Contract(s) for the construction of the Project shall be awarded by Subdivider to the qualified contractor(s) in accordance with Required Contracting Procedures, as mutually determined by Subdivider and City’s authorized representative(s). In the event of a dispute, the City shall have ultimate authority to determine to which contractor Subdivider is to award the bid. 4.4.1 In the event that the lowest responsible and reliable bid exceeds the Estimated Cost, any reimbursement for said increase shall be subject to approval by Change Order pursuant to Section 3.3.3 following award of contract. 4.4.1.1 In the event City Council does not approve the increased cost, at the City’s option: 4.4.1.1.1 City may terminate this Agreement. In the event the Agreement is terminated, the obligations of Subdivider, with the exception of Property acquisition (where applicable), pursuant to this Agreement for the construction of Project shall be released without further liability. This release shall in no way affect the obligations of Subdivider with respect to any terms or conditions of the VTMs, TMs, Development Agreements, or other approvals and agreements with City. However, prior to termination of this Agreement, City shall reimburse Subdivider (at City’s option with either FBA credits or cash reimbursement) for the engineering and design costs reasonably incurred and expended by Subdivider in accordance with this Agreement and within the Estimated Cost in accordance with Section

Bid Opening and Award of Contract. The Engineers shall provide services to assist in the bid letting process and shall prepare a tabulation of bids for the Owner and shall advise the Owner in making award of contract. After award of contract is made, the Engineers shall assist in the preparation of the necessary contract documents. During the bidding phase, the Engineers shall advise the Owner of the responsiveness of each proposal submitted.
Bid Opening and Award of Contract. Developer shall provide City with a copy of the tabulation of competitive bid results. Contract(s) for the construction of Project Improvements shall be awarded by Developer pursuant to CVMC §2.56.160(H)(2)(d). In the event that the best qualified contractor’s bid, combined with a reasonable amount for contingencies, exceeds the Estimated Cost, the increase in the costs must be approved by City Manager pursuant to Section 4.2.3 prior to awarding the contract. In the event the City Manager does not approve the increased cost, this Agreement, at the City’s option, may be terminated, or Project Improvements may be rebid and/or redesigned. In the event that the Agreement is terminated, the design costs will be reimbursed to Developer from the [Funding Source] Fund. City shall reimburse Developer with cash reimbursement for the Reimbursable Costs related to engineering and design expended by Developer prior to termination of this Agreement pursuant to Article XVI. Developer shall provide City with copies of all executed contracts.

  • Award of Contract PLACE MENT OF ORDER (a) The Institute shall consider placement of orders for jobs on those bidders whose offers have been found technical, commercially and financially acceptable.   • Nurses Unit The appointment of two (2) full-time employees to the same budgeted regular position may be authorized by the Director of Human Resources to facilitate training, to make assignments to a position which is vacant due to extended authorized leave of absence, or in an emergency. The most recently hired dual appointee shall enjoy all of the benefits of regular employees except regular status, unless the most recently appointed dual appointee has regular status in the classification. The most recently appointed employee shall be notified in writing by the appointing authority and such notification will clearly define the benefits to which that employee is entitled. Upon return of the initial appointee or completion of the training period or emergency, the following procedure shall apply. If the most recently appointed dual appointee has regular status in the same classification, he/she shall be placed in a vacant position in the same classification in the department/group. If no position is available, the employee shall be laid off, pursuant to the layoff provisions of this Agreement; provided, however, that the initial appointee shall be excluded from the order of layoff. If the most recently appointed dual appointee does not have regular status in the classification, he/she may be appointed to a vacant position in the same classification in the department/group, however, he/she shall be required to serve a probationary period unless waived by the Director of Human Resources. If the most recently appointed dual appointee held prior regular status in a lower classification immediately preceding the dual appointment, he/she shall have the right to return to the former classification and department. If he/she has not held prior regular status in a lower level classification, he/she shall be terminated.

  • Period of Contract All obligations of Purchaser shall be discharged not later than “Termination Date” stated in A15, unless it is adjusted pursuant to B8.21 or B8.212 or extended pursuant to B8.23 or B8.32, except- ing only those obligations for which Forest Service has given written permission to delay performance. Such writ- ten permission shall be considered a Contract Term Ad- justment for the purpose of Purchaser completing per- formance of obligations covered by such permission.
