Call-in Procedure. “Call-In” refers to shifts that are not regularly scheduled and are assigned less than 14 days in advance of the shift start date. 1. For call-in purposes, employees will be called in accordance with 22.11(C)(3) or 22.11(C)(4). Once an employee accepts a shift(s), it cannot be cancelled by the employee unless prior authorization has been given by the Manager. (i.) The parties recognize that substitute employees are expected to regularly cover absences on a scheduled and on a call-in basis. In the event there are available hours which the Employer intends to fill at Ventures, Downtown Centre or Employment Supports the Employer shall, prior to utilizing the call- in procedure in sub-article 22.11(C)(4) offer the hours to employees already scheduled to work fewer hours that day at the location, in order of seniority, provided the employee would not work in excess of forty-four (44) hours per week as a result of accepting the available hours, unless proper authorization is given. 4. The parties agree to the following procedure to fill available hours not filled pursuant to sub-article 22.11(C)(3): TriCarm availability at the time of the call for each location shall be utilized to fill all hours of work that become available over and above the regularly scheduled hours. a. STEP 1: In the event there are available hours which the Employer intends to fill, the available hours shall first be offered, in order of seniority, to employees assigned to the unit in accordance with their availability on the TriCarm system, provided that the employee would not work two consecutive shifts that are in excess of thirteen (13) hours combined or in excess of forty-four (44) hours per week as a result of accepting the available hours. b. A call-in sheet will be completed for each call-in. Each call will be indicated on the call-in sheet, provided and how the call was answered, as either "worked," "no answer," or, "refused". If more than one shift is available, all available shifts will be offered to each employee (if qualified) and the employee would may select which of those shifts she will accept, and the remaining shifts will be filled by continuing the call-in. If an employee indicates availability, and consistently is not work available when called, the Employer may remove the employee from the call-in excess of fortylist for the next schedule. “Consistently not available,” shall mean a call-four (44) hours per week as in is refused three times during the schedule. If a result of accepting call-in is answered by another person or an answering machine, the Employer shall leave a message that a call-in is available hours, unless proper authorization is given. 4and for what shift. The parties agree Employer will continue its efforts to fill the staff shortage. If an employee responds to a message and accepts the call-in prior to it being filled, she shall be assigned the vacancy. Many part-time staff have regularly scheduled shifts at multiple facilities covered by this agreement. Their first commitment is to those shifts. If an employee who was not scheduled to work and had indicated they were available is missed such employee shall either: i. If the call was made by a member of the bargaining unit, be offered the next call-in for which she is available. If the missed shift would have resulted in overtime, the employee may have the option of working one and one- half (1.5) times the amount of hours; however, all hours will be paid at the employee’s regular rate; no overtime rate will be paid, or ii. If the call was made by a management or office employee, the worker shall be scheduled to work as an extra at a time mutually agreed between the Employer and the Employee, and will be compensated according to the following procedure to fill available hours not filled pursuant to sub-article 22.11(C)(3): TriCarm availability at the time conditions of the call for each location shall be utilized to fill all hours of work that become available over and above the regularly scheduled hourscall-in shift. a. Call-in Procedure. “CallThe Employer will offer employees work opportunities, which arise after the schedule is posted, on a rotating basis in accordance with this sub-In” refers to shifts that article. a. Each classification will have an A list, a B list and a C list. The A list will show part-time employees. Employees working shifts of less than seven and one-half (7½) hours and who have not advised of provide their availability to work shifts of up to seven and one-half (7½) hours prior to the start of the schedule, will be included on the A list for call in purposes. d. The parties agree to the following procedure to fill available hours not filled pursuant to sub-article 22.11(C)(3): TriCarm availability at the time of the call for each location list shall be utilized to fill all hours of work that become available over and above the regularly scheduled hours. a. STEP 1: In the event there are available hours which the Employer intends to fill, the available hours shall first be offered, called in order of seniority, to seniority beginning with the most senior employees assigned to until the unit in accordance with their availability staff shortage is filled. Each call will be indicated on the TriCarm call-in sheet as to “worked”, “no answer”, “message left”, “refused”. If the employee’s telephone is answered by a recording device or service or paging system, provided that the Employer shall advise of the call-in opportunity, or leave a call back number. The Employer shall continue the call-in process. If the employee called, having been left a message or a call back number, calls the Employer before the call-in is filled, and accepts the work, the employee will be given the call-in. If more than one employee has been left a message, or a call back number, the first employee to return the call and accept the work receives the work. Regardless, if the work has been accepted, by another employee, employees calling back have lost the opportunity. If the employee’s telephone has been answered by a recording device or service, or a paging system, the call-in sheet will show “no answer”, “message left”. The Employer shall bypass an employee on the list who would not work two consecutive shifts be eligible for overtime premium if called into work, until such time as all employees that are available would be eligible for overtime pay. Call-in Procedure. “Call‌ (a) Casual employees and regular part-In” refers time employees who wish to shifts that are not regularly scheduled and are assigned less than 14 days in advance of the shift start date. 1. For call-in purposes, employees will be called for casual shifts must provide their availability to the Employer in accordance with 22.11(C)(3) or 22.11(C)(4). Shifts at Ventures, Downtown Centre or employment Supports shall be filled pursuant to sub article 22.11(C)(3)(1) January 1 – 7 for period February through May;‌ (2) May 1 – 7 for period June through September; and (3) September 1 – 7 for period October through January. ii. Shifts in all other areas shall be filled pursuant to sub-article 22.11(C)(4(b) except that available shifts will not be offered to employee already scheduled to work during the available hours, to Casual employees on vacation or other approved leave or to employees who have not advised of their must provide reasonable availability for the shift to be filledincluding nights and/or weekends. 3. (f) Casual employees who wish to be unavailable for a period in excess of fortytwo weeks must apply to the Employer in writing for an unpaid leave of absence a minimum of four weeks in advance of the start date of the desired leave. The Employer will not unreasonably deny such requests for leave of absence. (g) Casual and regular part-four time employees who submit availability must provide contact information where they can be reached two hours before and two hours into each shift for which they have stated availability. (44h) If a casual employee fails to answer a call from the Employer during the two hours per week before and two hours into each shift for which he/she has stated availability, the Employer will move immediately to the next eligible casual employee on the seniority list. If a casual employee who does not answer a call during the two hours before and two hours into each shift for which he/she has stated availability does not call back within 30 minutes he/she will be deemed to have refused the shift. (i) A casual employee who answers a call and refuses an offer of a shift within his/her stated period of availability except as a result of accepting the available hours, unless proper authorization is givenlegitimate illness or emergency will be deemed to have refused a shift. 4(j) A casual employee who refuses five shifts during the availability period may be subject to termination but the Employer will have to show cause. Succeeding call-ins will commence with the person listed below the last person to accept a call in and so on, on a rotational basis. c. If the call-in is for a straight time shift, the employee will be offered all of the straight time shifts known to be available in the next forty-eight (48) hour period. Overtime will be distributed by seniority to all employees provided they receive the minimum four (444) hours per week as a result of accepting the available hourshour call-in. b. STEP 2: Where Overtime of less than four (4) hours may be offered to existing Officers already on duty by seniority, with the available understanding that the most junior employee on duty may be required by the Hospital to stay if other senior employees decline the work. c. During unforeseen circumstances where the overtime of less than four (4) hours cannot be filled utilizing the above procedureextends beyond four (4) hours, the available hours shall be offered, Hospital will make every reasonable effort to utilize the call-in order of seniority, to employees from outside the Unit who have been orientated to the location, in accordance with their availability on the TriCarm system, provided the employee would not work two consecutive shifts in excess of thirteen (13) hours combined or in excess of forty-four (44) hours per week as a result of accepting the available hoursprocedure.

(f) Availability Sheets will be provided in conjunction when each new four week schedule is posted. Such availability sheets will also be used in shift re-allocation. Each part time employee is required to be available to the employer for a minimum of 24 hours per week. All part time employees will be called required to identify shifts, in accordance with 22.11(C)(3) addition to their regularly scheduled shifts, that they will be available to work if called. Failure to accept such shifts or 22.11(C)(4)failure to show up for regular scheduled shifts shall be deemed as a refusal. Three refusals in a four week schedule may result in disciplinary measures and in loss of master scheduled shifts for an appropriate period of time, at which the employee will remain only on the call-in list. Once an employee accepts has fulfilled their obligation to work 24 hours in a shift(s)week no refusals will be noted. 10:05 Overtime for full time Employees shall be paid at the rate of time and one-half for all hours worked in excess of the normal scheduled shifts on an Employee’s scheduled day off, it cannot be cancelled or, in excess of 80 hours during any two (2) week pay period. 10:06 Employees shall take their breaks in the staff room designated for that purpose unless that room is otherwise occupied by mutual consent of the employee unless prior authorization has been given by Employer and the ManagerUnion.
