CASH PAYMENT IN LIEU OF VACATION LEAVE. 1. An employee who accrues vacation leave under section 23.A.1 who leaves the County service for any reason shall be paid at the biweekly or hourly rate for each classification as set forth in Appendix "A" for unused vacation accrued to the date of his/her separation. Employees who accrue vacation leave under section 23.A.1 shall have the primary responsibility to schedule and take sufficient vacation leave to reduce their accrued vacation leave balances to levels which will permit further vacation accrual. The Sheriff shall make a reasonable effort to accommodate written vacation leave requests submitted by employees which state that the purpose of such request is to reduce accrued vacation leave balances to a level which will permit further vacation accrual. 2. An employee who accrues vacation leave under section 23.A.2 who leaves the County service for any reason shall be paid at the biweekly or hourly rate for each classification as set forth in Appendix "A" for unused vacation accrued to the date of his/her separation, provided that such entitlement shall not exceed vacation earned during the two years of employment preceding such separation. Employees who accrue vacation leave under section 23.A.2 shall have the primary responsibility to schedule and take sufficient vacation leave to reduce their accrued vacation leave balances to levels which do not exceed the amount for which they can receive cash payment hereunder upon termination. Effective December 29, 2019, for all persons covered by this MOU: An employee who accrues vacation leave under section 23.A.2 who has received pay pursuant to Labor Code section 4850 subsection 10.A.3., and who leaves the County service for a period of any reason shall be paid at least 6 months during the 18 months which precede biweekly or hourly rate for each classification as set forth in Appendix A, for unused vacation accrued to the date of his/her retirement or other termination separation provided that such entitlement shall be entitled to cash payment not exceed the employee’s applicable maximum vacation balance as set forth in subsection 10.C.3. Effective December 29, 2019, the provisions of untaken vacation leave accrued as of the commencement of such section 4850 pay, within the limitations provided above, plus the amount of vacation accrued from subsections 10.B.1. and after the date such section 4850 commences10.B.2. shall no longer apply.
