Center Closure. The Borough reserves the right, at its discretion, to close the Center, or any space within the Center, including the Aquatic Center, in the case of emergency or other contingency (including but not limited to security, maintenance, or health and safety issues). If a temporary closure occurs lasting seven (7) calendar days or less, such that VSC is unable to utilize the facilities on or at a date or time specified for VSC, no refund shall be issued. If the temporary closure lasts in excess of seven (7) calendar day, through no fault of VSC, the Borough shall issue to VSC a pro rata fee refund of any prepaid fees for the period of closure exceeding seven (7) days. If the Center or the Aquatic Center is anticipated to be closed for the remainder of VSC's then current rental term, causing VSC's usage to cease, through no fault of VSC, this Agreement shall terminate and the parties thereafter shall have no further liability or obligation to each other, except for a pro rata fee refund to VSC of any prepaid use fees.

Center Closure. In the event the Center is closed by the Government, employees that do not work will be compensated as directed by the Government. The Government and or Management have the right to designate the essential functions that must be performed to protect the interest of the Center. In these cases, the employer will select the most qualified employee(s) irrespective of seniority to ensure mission requirements are satisfied. When essential employees are required to report to work or to remain at work, he/she will be compensated at his/her regular hourly rate of pay. If employees that did not work during the Center Closure are compensated at his/her regular hourly rate then the essential employees that did work will receive one and one-half their hourly rate.   • PLANT CLOSURE 29.01 In the event the Company closes the plant at the Cambridge location as a result of the loss of business or a discontinuation of all operations, severance pay will be calculated at one (1) week’s regular pay per year of service. The severance payment, so calculated, is inclusive of any severance payment required by the Ontario Employment Standards Act (Revised 2000).   • Account Closure At any time, for any reason, we may take any of these actions subject to applicable law:

  • Emergency Closures A. The University’s inability to make a Room available to me for any reason beyond the University’s control including, but not limited to, natural disaster, fire, flood, earthquake, condemnation, pandemic, quarantine, utility malfunction, infestation, or other emergency or force majeure event shall not constitute a breach of this Agreement by the University. In such circumstances, the University shall have no liability to me in any way for injuries, reimbursement, damages, inconvenience, annoyance or compensation of any kind. The University may attempt to find, but cannot guarantee, an alternative space for me. If the unavailability of my Room or an alternative space persists for more than 72 hours, I may terminate this Agreement and Check out during said unavailability without penalty provided that I shall be responsible for all financial obligations incurred up to the date of such termination. The University agrees to provide me with a pro rata refund, calculated from the date of such termination to the end of the Agreement Period, of any prepaid housing and dining payment made to the University, and to return my Deposit pursuant to this Agreement. Upon resumption of standard operations, Agreement Termination requirements and charges will apply as described in Section XIV.

  • Emergency Closing 1. Management shall decide when, if, and to what extent State facilities shall remain open or closed during emergencies, such as adverse weather conditions, acts of God, equipment breakdown, inoperable bathroom facilities, extreme office temperatures, etc.

  • Summer Session A. All ASEs employed in the Summer Session shall receive the same general range adjustment as ASEs received in the preceding Fall term.

  • Collocation Transfer of Responsibility Collocation Transfer of Responsibility is the transfer of a Collocation site from vacating CLEC (current CLEC leasing the space in the Premises) to an assuming CLEC.
