Commencement and conduct of Survey. (a) Subject to clause 11(b), the Corporation will use its, and must ensure the Aboriginal Heritage Service Provider and the Principal Aboriginal Heritage Consultant (if different to the Aboriginal Heritage Service Provider) each uses its, best endeavours to commence the Survey within the time agreed by the Corporation and the Government Proponent, or in the absence of such agreement, within 35 Business Days after the Survey Agreement Date.
Commencement and conduct of Survey. (a) If the RC is contracting the Aboriginal Heritage Service Provider, the RC will use its, and must ensure that the Aboriginal Heritage Service Provider and the Principal Aboriginal Heritage Consultant (if different to the Aboriginal Heritage Service Provider) each uses its best endeavours to commence the Survey within the time agreed by the Parties, or in the absence of agreement within 30 Business Days after the Survey Agreement Date unless clauses 11(c) and 18.9 apply, in which case the time for commencement of the Survey will be extended in accordance with the timeframes set out in the relevant clauses if the Dispute is resolved.
