Common use of Compassionate Transfer Clause in Contracts

Compassionate Transfer. 9.01 A regular Employee who has worked for thirty (30) years or who has attained the age of fifty five (55), and who is unable to carry out the full duties and responsibilities of their job (and has had their condition substantiated by an independent medical practitioner) may be transferred to other work they are capable of performing, if available, and will remain at their pre-transfer rate (red-circled). This will remain in effect until such time the Employee attains their retirement age eligibility as defined by O.M.E.R.S.
