Compensation Awards and Sick Leave. Absences resulting from work-incurred sickness or injury may be charged against sick leave credit at the rate of one day per each day of absence. Employ- ees who fully exhaust their sick leave accruals will be paid at the workers’ compensation insurance rate by the Laboratory’s Workers’Compensation insurance carrier. Any subsequent Workers’ Compensation xxxx- bursement to the Laboratory for wages will be credited to the employee’s sick leave accruals to the extent of the reimbursement. The decision as to whether or not absences are covered by this Section will be based upon Workers’ Compensation Board rulings, except that such deci- sions will be made by the Laboratory in the absence of or pending such rulings. In lieu of the above, employees may elect to receive statutory benefits (with applicable waiting periods) un- der New York State Workers’Compensation Law.
