Confirmed Positive Test Results. 1. The employment status of any Provider’s employee and/or subcontractor found to be in violation of this Drug & Alcohol Policy, including disciplinary action taken, shall be at the sole discretion of the Provider. 2. The Provider shall immediately remove any employee and/or subcontractor with a confirmed positive drug and/or alcohol test result from the work and Company property, and shall provide the individual’s name and identifiers (name, DOB and mailing address) to the Company at Xxxxxxxx-Xxxxxx@xx-xxxxxxxx.xxx. 3. The Company maintains a “Barred Persons” list of individuals who have been barred from visiting or working on Company premises or doing Company work. The names of Provider and subcontractor employees assigned to the work will be compared against this list, and the Provider or subcontractor shall remove from the Work, any of its employees who appear on the “Barred Persons” list.

Medical Review Officer Notification (MRO) After confirmation of a positive test by the laboratory, it will be necessary for the MRO to speak with the employee to allow him/her the opportunity to explain the positive test. Employees who fail to contact the MRO within 2 days of their notification will be reported as a non-contact positive, and reclassified to the Inactive Suspended Pool. 2. Illegal and/or Controlled Substances Any employee who receives a confirmed positive test result for a substance prohibited by the Consortium Policy will be reclassified to the Inactive Suspended Pool pending the satisfactory completion of the reinstatement requirements. 3. Alcoholic or Intoxicating Beverages The following actions that involve alcoholic beverages are prohibited by the Consortium Policy and any violation thereof and will be cause for the employee to be reclassified to the Inactive Suspended Pool: a. The consumption, manufacture, distribution, possession, use, sale, or storage of any alcoholic beverage while on or in the work place is prohibited. b. The performance or attempted performance of any job function or the operation of any Owner’s or Employer’s property or equipment while Under the Influence of Alcohol. c. An alcohol screening and confirmation result of .04 BAC or greater will cause the employee to be reclassified to the Inactive Suspended Pool. A result of .0200 - .0399 BAC shall require the employee’s removal from the job site for a minimum of 24 hours.

  • Test Results The employer, upon request from an employee or former employee, will provide the confidential written report issued pursuant to 4.9 of the Canadian Model in respect to that employee or former employee.

  • Feasibility Study A feasibility study will identify the potential costs, service quality and other benefits which would result from contracting out the work in question. The cost analysis for the feasibility study shall not include the Employer’s indirect overhead costs for existing salaries or wages and benefits for administrative staff or for rent, equipment, utilities, and materials, except to the extent that such costs are attributable solely to performing the services to be contracted out. Upon completion of the feasibility study, the Employer agrees to furnish the Union with a copy if the feasibility study, the bid from the Apparent Successful Bidder and all pertinent information upon which the Employer based its decision to contract out the work including, but not limited to, the total cost savings the Employer anticipates. The Employer shall not go forward with contracting out the work in question if more than sixty percent (60%) of any projected savings resulting from the contracting out are attributable to lower employee wage and benefit costs.

  • Random Testing Notwithstanding any provisions of the Collective Agreement or any special agreements appended thereto, section 4.6 of the Canadian Model will not be applied by agreement. If applied to a worker dispatched by the Union, it will be applied or deemed to be applied unilaterally by the Employer. The Union retains the right to grieve the legality of any imposition of random testing in accordance with the Grievance Procedure set out in this Collective Agreement.

  • Production definitively discontinued 10.1. If the holder of the approval completely ceases to manufacture a vehicle type approved in accordance with this Regulation, he shall so inform the authority which granted the approval.
