Construction and Maintenance of the Cable System. 3.1 Permits and General Obligations. The Franchisee shall be responsible for obtaining, at its own cost and expense, all generally applicable permits, licenses, or other forms of approval or authorization necessary to construct, operate, maintain or repair the Cable System, or any part thereof, prior to the commencement of any such activity. Construction, installation, and maintenance of the Cable System shall be performed in a safe, thorough and reliable manner using materials of good and durable quality. All transmission and distribution structures, poles, other lines, and equipment installed by the Franchisee for use in the Cable System in accordance with the terms and conditions of this Franchise Agreement shall be located so as to minimize the interference with the proper use of the Public Ways and the rights and reasonable convenience of property owners who own property that adjoins any such Public Way.
Construction and Maintenance of the Cable System. 3.1. Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of Title 7, entitled “Public Ways and Property, Chapter 1, Streets, Sidewalks and Other Public Places” of the Municipal Code of the City of East Peoria, as may be amended from time to time.
Construction and Maintenance of the Cable System. 3.1. Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of Title 4, Chapter 11, entitled “Construction of Utility Facilities in the Rights of Way,” of the Village of Oswego Municipal Code, as may be amended from time to time. Grantee will complete construction of the Cable System in the Initial Franchise Service Area no later than three (3) years from the date it commences with physical construction of the Cable System in the Public Way.

Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of Chapter 82, entitled “Construction of Utility Facilities In Public Rights-of- Way,” of the Xxxxxxxx Municipal Code, as may be amended from time to time.

Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of the Code of Ordinances, Village of Poplar Grove, Illinois, pertaining to occupancy in and construction of utility facilities in the Public Way by all occupants of the Public Way, as may be amended from time to time.

Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of Chapter 96 of the Municipal Code, Village of Niles, Illinois, Article II, entitled “Construction of Utility Facilities In The Rights-of-Way” as may be amended from time to time.

Except as may be otherwise provided in this Franchise Agreement, Grantee shall comply with all generally applicable provisions of the McHenry County, Illinois, Code of Ordinances pertaining to the occupancy and use of the Public Way that are generally applicable to all occupants and users of the Public Way, as may be amended from time to time. Grantee shall be a member of the Joint Utility Location Information for Underground Excavator (X.X.X.X.X.).
