Restoration of Public Ways. Grantee shall, at its own expense, restore any damage or disturbance caused to the public way as a result of its operation, construction, or maintenance of the Cable System to a condition reasonably comparable to the condition of the Streets immediately prior to such damage or disturbance.

Restoration of Public Ways. If during the course of the Grantee’s construction, operation, or maintenance of the Cable System there occurs a disturbance of any Public Way by the Grantee, Grantee shall replace and restore such Public Way to a condition reasonably comparable to the condition of the Public Way existing immediately prior to such disturbance.

Restoration of Public Ways. Franchisee shall repair any disturbance or damage to public property or private property caused by Franchisee’s construction, operation or repair of the Cable System promptly and in compliance with such standards and deadlines as may be specified by the City in writing. Franchisee agrees to compensate any entity whose person or property is damaged by Franchisee, or any contractor, subcontractor or agent of Franchisee in the course of the construction, operation or repair of the Cable System where the property is not fully restored by Franchisee to a condition as good or better than existed before the damage.

Restoration of Public Ways. If in connection with the construction, operation, maintenance, or repair of the Cable System, the Franchisee disturbs, alters, or damages any Public Way, the Franchisee agrees that it shall at its own cost and expense replace and restore any such Public Way to a condition reasonably comparable to the condition of the Public Way existing immediately prior to the disturbance as is practical within twenty (20) business days of completion of the work causing the disturbance. Upon failure of Franchisee to comply within the time specified and the Town having notified Franchisee in writing of the restoration and repairs required, the Town may cause proper restoration and repairs to be made and the expense of such work shall be paid by Franchisee upon demand by the Town.

The City Engineer shall make the final determination as to acceptability of repair and/or replacement of damaged facilities. In performing any excavation work in the public rights-of-way, the Franchisee will comply with all of the requirements of Chapter 35, or any subsequently adopted Chapter, of the City Code.
Restoration of Public Ways. The Contractor shall not cause damage, beyond normal wear and tear, to any street or roadway within the Town. In the event the Contractor causes damage to any street or roadway within the Town, the Contractor shall be given written notice to immediately cause such damage to be repaired under the supervision of the Town inspector. Such notice shall provide that in the event Contractor does not acknowledge responsibility for making such repairs within seven (7) days of notice, a hearing will be held by the Town Council on the question of responsibility for such damage. If at such hearing the Town Council finds that the damage was caused by Contractor and such damage was beyond normal wear and tear, the Town Council may request Contractor to cause such damage to be repaired under the supervision of the Town inspector and if such damage is not repaired within the time stated the Town Council may within its sole discretion terminate Contractor’s Franchise and right to use the public streets within the Town to carry on its business.
