Consultant’s Report. A report from the Construction Consultant to the effect that (i) it has received and approved the items required by paragraph (f) below, (ii) the Plans and Specifications have been approved by all applicable Governmental Authorities, (iii) the Improvements as shown by the Plans and Specifications will comply with applicable zoning and other Laws, (iv) a Construction Management Agreement and/or Trade Contracts are in effect which satisfactorily provide for the construction of the Improvements, subject, however, to the provisions of Section 4.01(e)(19) regarding signed Trade Contracts, (v) all roads and utilities necessary for the full utilization of the Improvements for their intended purposes have been completed, or the presently installed and proposed roads and utilities will be sufficient for the full utilization of the Improvements for their intended purpose and will be available to and servicing the Premises upon completion of the Improvements, (vi) the construction of the Improvements theretofore performed, if any, was performed in accordance with the Plans and Specifications and (vii) construction of the Improvements, along with all necessary roads and utilities, will be finished on or before the Completion Date; and to such other effects as Administrative Agent may reasonably request;
Consultant’s Report. A copy of the report from the Construction Consultant delivered to the First Lien Collateral Agent, to the effect that (i) it has received and reviewed the construction related items required by the Disbursement Agreement as of the date of such report in respect of the Project and certifications from the professionals of record asserting that (a) the available Plans and Specifications have been approved to the extent required at such time by all applicable Governmental Authorities and (b) the improvements as shown by the Plans and Specifications will comply with applicable zoning and other Laws in all material respects and (ii) construction of the improvements, along with all necessary roads and utilities, are expected to be finished on or before the Scheduled Completion Date (provided this condition shall be deemed satisfied if the Borrower uses commercially reasonable efforts to cause the Construction Consultant to consent to the Lender’s reliance on said report, subject to receipt of any necessary consent from the First Lien Administrative Agent);

Consultant’s Report. Lender shall have received reports ------------------- from Lender's Consultants, including the Inspecting Engineer, addressed to Lender regarding such matters as Lender requests and, without limiting the foregoing, to the effect that (a) the Plans conform with generally acceptable building construction practice, including architectural, structural, mechanical and electrical aspects thereof, (b) the Inspecting Engineer concurs with (i) the Hard Costs shown in the Project Budget, and (ii) the Construction Schedule prepared by Borrower, (c) based upon the information submitted by Borrower or such other Person as the Inspecting Engineer may deem necessary or appropriate, all permits, licenses and approvals required for the construction of the Project have been obtained to the extent applicable to the state of construction or no impediment exists to further required permits, licenses and approvals being timely obtained, (d) Contracts and Subcontracts are in effect which satisfactorily provide for the construction of the Project, (e) all roads and utilities necessary for the full utilization of the Project for its intended purposes have been completed or there are sufficient amounts budgeted for such improvements, (f) the construction of the Project theretofore performed has been completed substantially in accordance with the Plans reviewed by Inspecting Engineer and approved by Lender, and (g) the Project has, in the aggregate, reached a stated percentage of completion.
