COSTS NOT INCLUDED IN THE COST OF THE WORK. 21.4.1 The Cost of the Work will not include: 21.4.1.1 Salaries and other compensation of the Design-Builder’s personnel stationed at the Design-Builder’s principal office or offices other than the site office, except as specifically provided in Paragraphs 21.3.1.1.1 thru 21.3.1.1.4. 21.4.1.2 Expenses of the Design-Builder’s principal office and offices other than the Project site office except as specifically provided in Paragraph 21.3. 21.4.1.3 Overhead and general expenses, except as may be expressly included in this Article 21. 21.4.1.4 The Design-Builder’s capital expenses, including interest on the Design- Builder’s capital employed for the Work. 21.4.1.5 Rental costs of machinery and equipment, except as specifically provided in Paragraph 21.3.2. 21.4.1.6 Costs incurred in the performance of the Part 1 Contract. 21.4.1.7 Costs which would cause the GMP Contract Sum to be exceeded. 21.4.1.8 Interest payments of any kind. 21.4.1.9 The cost of defending suits or claims for royalties, licenses, infringement of patent or other intellectual property rights arising from requirements of the Contract Documents, payments made in accordance with legal judgments against the Design-Builder resulting from such suits or claims and payments of settlements made with the Owner’s consent. 21.4.1.10 Costs due to the negligence or failure of the Design-Builder, contractors, subcontractors or suppliers or any one directly or indirectly employed by any of them to fulfill a specific responsibility of the Design-Builder, contractors, subcontractors and suppliers or any one directly or indirectly employed by any of them for whose acts any of them may be liable. 21.4.1.11 Costs to repair or replace damaged or stolen material, equipment, temporary facilities and related items. 21.4.1.12 Bonuses and/or profit sharing for any employee of the Design-Builder. 21.4.1.13 Software and IT support, unless identified elsewhere in the GMP. 21.4.1.14 Costs associated with construction warranties. 21.4.1.15 Costs to remedy defective, rejected or nonconforming Work, materials or equipment. 21.4.1.16 Costs arising from Design-Builder’s contractual indemnification and defense obligations. 21.4.1.17 Liquidated or actual damages imposed by the Owner for failure to complete the Work in the Contract Time. 21.4.1.18 Attorney fees, expert witness fees and Costs incurred by the Design- Builder in any dispute with the Owner except as otherwise required by law.

COSTS NOT INCLUDED IN THE COST OF THE WORK. The following shall not be included in the Cost of Work to be paid by the Owner: (a) Costs attributable to the failure to perform of any Subcontractor or the bankruptcy or insolvency of any Subcontractor. (b) Legal and administrative costs to review and negotiate the Contract Documents. (c) Travel and subsistence expense of the Construction Manager, its officers or employees incurred while traveling between the Project and principal or branch offices, and travel in the metropolitan area of the Project, except for special consultants when agreed upon by the Owner and the Construction Manager jointly, in writing, in advance. (d) Xxxxx, penalties, sanctions, or impositions assessed or imposed by any governmental body, instrumentality, or tribunal arising from the fault of the Construction Manager or anyone under its control. (e) Costs incurred by the Construction Manager resulting from the failure of the Construction Manager or its Subcontractors to coordinate their work with that of the Owner and its contractors, if any, after agreeing to the Schedules, therefore, or failure of the Construction Manager to comply with directives of the Owner not in conflict with said Xxxxxxxxx. (f) Costs resulting from the failure of the Construction Manager or any Subcontractor to procure and maintain insurance as and to the extent required by the Contract Documents. (g) Any and all personnel costs, including, without limitation, wages, salaries, bonuses, and benefits not expressly provided for as an allowable Cost of the Work or approved by the Owner in writing in advance. (h) Premiums for insurance and bonds, or any insurance deductibles paid beyond what is required by the Contract Documents. The Construction Manager shall not be permitted to charge any costs for Subcontractor bonds, Subguard or subcontractor default insurance unless such costs are specifically approved in writing, in advance. If approved, such costs must be specifically identified in the GMP separately from the costs of the subcontract. (i) To the extent specifically included herein any and all home office overhead expense, or office expense at any location, except for site office expenses specifically allowed under the Contract Documents. (j) Costs related to the Construction Manager's indemnification obligations pursuant to Section 10 herein.   • Reimbursable Costs 5.3.1. To be considered eligible for reimbursement, costs have to be: • actually incurred, individually identifiable and verifiable, as backed by copies of supporting evidence, as the case may be in the Contractor’s official bookkeeping; this means that no lump sums will be eligible for reimbursement; • necessary in order to perform the tasks as specified in the Terms of Reference (Annex 2); and • cost effective and providing value for money 5.3.2. The following costs are never eligible for reimbursement: • costs for excess baggage; • costs that are covered by the per diem; and • costs that are covered from a source other than this Contract 5.3.3. Travel tickets are reimbursed by EFI up to the cost of economy class level on basis of the most cost efficient itinerary, taking into account ticket price, travel duration, number of connections and safety of the transporting company. 5.3.4. For travel tickets, EFI requires the following documentation as supporting evidence: copies of tickets or electronic reservation, invoices and boarding cards. This documentation must clearly show the class of travel used, the time of travel and the amount paid.

  • Excluded Expenditures The Recipient undertakes that the proceeds of the Financing shall not be used to finance Excluded Expenditures. If the Association determines at any time that an amount of the Financing was used to make a payment for an Excluded Expenditure, the Recipient shall, promptly upon notice from the Association, refund an amount equal to the amount of such payment to the Association. Amounts refunded to the Association upon such request shall be cancelled.

  • Complete Work without Extra Cost Except to the extent otherwise specifically stated in this contract, the Contractor shall obtain and provide, without additional cost to the City, all labor, materials, equipment, transportation, facilities, services, permits, and licenses necessary to perform the Work.

  • Cost of Bidding 6.1 The bidder shall bear all costs associated with the preparation and submission of his Bid, and the Employer will in no case be responsible and liable for those costs.

  • Direct Costs The Contractor shall separately identify each item of deleted and added work associated with the change or other condition giving rise to entitlement to an equitable adjustment, including increases or decreases to unchanged work impacted by the change. For each item of work so identified, the Contractor shall propose for itself and, if applicable, its first two tiers of subcontractors, the following direct costs: (1) Material cost broken down by trade, supplier, material description, quantity of material units, and unit cost (including all manufacturing burden associated with material fabrication and cost of delivery to site, unless separately itemized); (2) Labor cost broken down by trade, employer, occupation, quantity of labor hours, and burdened hourly labor rate, together with itemization of applied labor burdens (exclusive of employer’s overhead, profit, and any labor cost burdens carried in employer’s overhead rate); (3) Cost of equipment required to perform the work, identified with material to be placed or operation to be performed; (4) Cost of preparation and/or revision to shop drawings and other submittals with detail set forth in paragraphs (e)(1) and (e)(2) of this clause; (5) Delivery costs, if not included in material unit costs; (6) Time-related costs not separately identified as direct costs, and not included in the Contractor’s or subcontractors’ overhead rates, as specified in paragraph

  • Ineligible Costs The Recipient agrees that, except as the Federal Government determines otherwise in writing, FTA will exclude ineligible costs incurred in connection with the Award or otherwise, such as: (1) A cost the Recipient has incurred before the Effective Date of the Award as documented in the Underlying Agreement or any Amendments thereto that is not accompanied by FTA’s written approval, including, but not limited to, pre-award authority or a Letter of No Prejudice, and permitted by applicable federal law, regulation, guidance, or the Underlying Agreement or any Amendments thereto; (2) A cost not included in the most recent Award Budget; (3) A cost for property or services received in connection with any third party agreement lacking any FTA approval or concurrence in writing that is required; (4) An ordinary governmental or operating cost not applicable to the Award, as prohibited by 49 U.S.C. § 5323(h)(1); (5) A profit or fee for services provided by the Recipient or any of its Subrecipients in implementing the Award; or (6) A cost that is ineligible for FTA participation as provided in applicable federal law, regulation, requirement, or guidance.

  • Subcontract Costs Payments made by the Construction Manager to Subcontractors in accordance with the requirements of the subcontracts and this Agreement.
