Costs Reimbursed. If the Bank pays any amounts in connection with (a) any license, fee or similar charges, or penalties or interest thereon, (b) obtaining any insurance or paying the premium or premiums therefor, (c) performing or causing to be performed any repair, replacement, rebuilding or other work or (d) taxes or municipal or governmental assessments, rates, charges, impositions or liens with respect to the Collateral, then the Grantor shall, on the demand of the Bank, repay or cause to be repaid such amount to the Bank, and such amounts so required to be repaid shall be Obligations.
Costs Reimbursed. The Recipient agrees that the Project costs eligible for Federal participation must comply with all the following requirements. Except to the extent that FTA determines otherwise in writing, Project costs must be:
(1) Consistent with the Project Description, the Approved Project Budget, and other provisions of the Grant Agreement or Cooperative Agreement for the Project and this Master Agreement,
(2) Necessary in order to accomplish the Project,
(3) Reasonable for the goods or services purchased,
(4) Actual net costs to the Recipient (i.e., the price paid minus any refunds, rebates, or other items of value received by the Recipient that have the effect of reducing the cost actually incurred, excluding program income),
(5) Incurred for work performed after the Effective Date of the Grant Agreement or Cooperative Agreement for the Project, except to the extent that the Federal Government determines otherwise in writing,
(6) Satisfactorily documented,
(7) Treated consistently in accordance with accounting principles and procedures approved by the Federal Government for the Recipient, and with accounting principles and procedures approved by the Recipient for its subrecipients, lessees, third party contractors, and other participants in the Project,
(8) Eligible for Federal participation under Federal law and regulations and in accordance with applicable Federal directives, and
(9) In compliance with U.S. DOT regulations pertaining to allowable costs at 49 C.F.R. § 18.22(b) or 49 C.F.R. § 19.27, which regulations specify the applicability of U.S. OMB circulars and Federal Acquisition Regulation (FAR) provisions as follows:
(a) U.S. OMB guidance for Grants and Agreements, “Cost Principles for State, Local, and Indian Tribal Governments (OMB Circular A-87),” 2 C.F.R. Part 225, applies to Project costs incurred by a Recipient that is a State, local government, or Indian tribal government.
(b) U.S. OMB guidance for Grants and Agreements, “Cost Principles for Educational Institutions (OMB Circular A-21),” 2 C.F.R. Part 220, applies to Project costs incurred by a Recipient that is an institution of higher education.
(c) U.S. OMB guidance for Grants and Agreements “Cost Principles for Non-profit Organizations (OMB Circular A-122),” 2 C.F.R. Part 230, applies to Project costs incurred by a Recipient that is a private nonprofit organization.

Costs Reimbursed. The Indian Tribe agrees that Tribal Transit Project costs that are eligible for Federal participation must comply with all the following requirements. Except to the extent that FTA determines otherwise in writing, to be eligible for reimbursement, Tribal Transit Project costs must be:
(1) Consistent with the Tribal Transit Project Description, the Approved Project Budget, and other terms of the Grant Agreement for the Tribal Transit Project and this Tribal Transit Program Master Agreement,
(2) Necessary in order to accomplish the Tribal Transit Project,
(3) Reasonable for the goods or services purchased,
(4) Actual net costs to the Indian Tribe (i.e., the price paid minus any refunds, rebates, or other items of value received by the Indian Tribe that have the effect of reducing the cost actually incurred, excluding program income),
(5) Incurred for work performed after the Effective Date of the Grant Agreement for the Tribal Transit Project, except to the extent that the Federal Government determines otherwise in writing,
(6) Satisfactorily documented,
(7) Treated consistently in accordance with accounting principles and procedures approved by the Federal Government for the Indian Tribe, and with accounting principles and procedures approved by the Indian Tribe for its subrecipients, lessees, third party contractors, or other participants in the Tribal Transit Project.
(8) Eligible for Federal participation under Federal law, regulations, or directives, and
(9) In compliance with the provisions of U.S. OMB Guidance for Grants and Agreements, “Cost Principles for State, Local, and Indian Tribal Governments (OMB Circular A-87),” 2 C.F.R. Part 225.
Costs Reimbursed. If an Event of Default hereunder shall occur, ---------------- Obligor shall pay to Bank attorneys' and paralegal fees equal to 15% of the unpaid balance of the Obligations at the time of default (but not exceeding the amount permitted by applicable law), plus Court costs and other expenses which may be incurred by Bank in the administration hereof during the continuance of any Event of Default or the enforcement or attempted enforcement of its rights hereunder, whether against any third party or Obligor (or any endorser, guarantor or co-maker of any Collateral or Obligations). Obligor shall reimburse Bank for all costs of collection including salaries, out-of-pocket, travel and living expenses and the hiring of agents, consultants and accountants. All sums of money thus expended, and all other monies expended by Bank to protect its interests in the Collateral (including insurance taxes or repairs) shall be Obligations payable on demand.

1. Conform with the Approved Project Description, the Project Budget, and all other terms of the agreement;
2. Are necessary in order to accomplish the Project;
3. Are reasonable for the goods or services purchased;
4. Are actual net costs to the Transit Provider (i.e., the price paid minus any refunds, rebates, or other items of value received by the Transit Provider that have the effect of reducing the cost actually incurred, excluding program income);
5. Are incurred within the agreement time period;
6. Are satisfactorily documented;
7. Are treated consistently in accordance with accounting principles and procedures approved by the State;
8. Are eligible under state and federal law, regulation, rule, or guidelines for participation; and
9. Unless permitted otherwise by federal statute or regulation, comply with the: (1) U.S. Office of Management and Budget (OMB) Circular A-87, Revised, "Cost Principles for State and Local Governments" if the Transit Provider is a local government or an Indian tribal government; (2) OMB Circular A-21, Revised, "Cost Principles for Educational Institutions" if the Transit Provider is an institution of higher education; (3) OMB Circular A-122, Revised, "Cost Principles for Non-Profit Organizations" if the Transit Provider is a private nonprofit organization; or (4) Federal Acquisition Regulation, 48 CFR Chapter I, Subpart 31.2, "Contracts with Commercial Organizations" if the Transit Provider is a for-profit organization. Additionally, the Transit Provider shall comply with the requirements of the Single Audit Act of 1984, P.L. 98-502, ensuring that the single audit report includes the coverage stipulated in OMB Circular A-133.
Costs Reimbursed. Except as FTA determines otherwise in writing, the Indian Tribe agrees that Tribal Transit Project costs must be:
