Common use of Court Witness Leave Clause in Contracts

Court Witness Leave. Approved use of Personal Necessity Leave for required appearances in court during normal work hours under official order as litigant or witness (Education Code §44036) or the employee is a victim of a crime (Labor Code §230.2). When the appearance is due to an employee’s actions as a “Good Samaritan” (Civil Code §1714.2 or Health and Safety Code §1799.102), the time off shall not be charged to sick leave.
