Common use of Custodial/Maintenance Clause in Contracts

Custodial/Maintenance. A layoff shall be defined as a reduction in the workforce or a reduction in the normal hours of work for an employee whose hours have been unilaterally reduced by the Employer by more than three (3) hours per week. 1) The incumbent employee has the option to : i) Accept the reduction and remain in the position, or ii) To exercise their seniority rights through bumping, or iii) Choose to be laid off. 2) In the event of a reduction in staff, seniority by classification as defined in 7.01 (2) shall apply with regards to layoff.
