Damage or Theft of Personal Property. All personal property brought into the Premises shall be at the risk of the Tenant only and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any acts of co-tenants, or other occupants of the Building, or any other person, except, with respect to damage to the Premises, as may be occasioned by the negligent or willful act of the Landlord, its employees and agents.
Damage or Theft of Personal Property. All personal property brought ------------------------------------ into Demised Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 hereof. Unless caused by the negligence of Landlord or its employees, Landlord shall not at any time be liable for damage to any property in or upon the Demised Premises which results from power surges or other deviations from the constancy of the electrical service or from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever.

All personal property brought into the Premises or improvements and alterations made by Tenant (whether or not approved by Landlord), and by Tenant’s members, occupants, employees, agents, guests, licensees, or invitees, shall be at the risk of Tenant only, and unless due to Landlord’s gross negligence or willful misconduct, Landlord shall not be liable for theft thereof or any damage or loss of any kind whatsoever. Unless due to Landlord’s gross negligence, Landlord shall not at any time be liable for damage to any property in or upon the Premises, which results from fire, gas, smoke, water, rain, ice, snow, wind, or leaks from any part of the Premises or from the pipes or plumbing work, or from any other place whatsoever. In the event of any insurance claim that can be made against one or more of the insurance policies of Landlord, Tenant, and Tenant’s members and occupants, the insurance policies of Tenant and Tenant’s members and occupants shall be primary with respect to any sickness, accident, injury or death, or for loss or damage to any property, or for any other legal liabilities which might be imposed for damage to persons or property. The terms of this Paragraph shall survive any termination of this Lease.

Landlord shall not at any time be liable for damage to any personal property of Tenant, its employees, sublessees, or invitees in or upon the Demised Premises, which results from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever unless damage is caused by Landlord's negligence or misconduct.
Damage or Theft of Personal Property. All personal property brought into the Premises by Tenant or by Tenant’s employees, agents, or business visitors shall be at the risk of Tenant, and Landlord shall not be liable for theft of or damage to that property occasioned by any act of co-tenants, occupants, invitees or other users of the Building or of any other person. Tenant shall carry insurance under Article 5 providing coverage for damage to any property in or upon the Premises that results from gas, smoke, water, rain, ice or snow that issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the Building, or from any other source whatsoever.

Landlord shall not at any time be liable for damage to any property in or upon the Premises, which results from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever, unless caused by Landlord’s gross negligence or willful misconduct. Notwithstanding the foregoing, Landlord agrees that it shall use commercially reasonable efforts to cause entrance to the Building to be restricted and obtained through a card access system after normal business hours (i.e., 8:00 a.m. to 6:00 p.m. Monday through Friday and 8:00 a.m. to 1:00 p.m. on Saturday) and that 24-hour security will be present at the Office Park including unarmed roving patrol and cameras located at the parking deck and Building entrances.
