Each Party shall allow the temporary entry of a business person who, at the request of an enterprise of the other party registered bilateral enterprises referred to in paragraph 7, intends to perform any activity listed in appendix 1 to this Annex, without requiring authorisation to use, provided that, in addition to comply with existing immigration measures applicable to temporary entry, displays:

Business Visitors. Business visitors being natural persons seeking to travel to Australia for business purposes whose remuneration and financial support for the duration of the visit must be derived from sources outside Australia and who must not engage in making direct sales to the general public or in supplying the services themselves. Business Visitors. 1. Subject to the provisions of Article 17, an individual who is a resident of a Contracting State shall be exempt from tax in the other Contracting State on income in respect of an employment including independent professional service exercised in any calendar year in the other Contracting State, if— (a) he is present in the other Contracting State for a period or periods not exceeding in the aggregate 183 days during that year; and (b) the remuneration for his services is paid by or on behalf of a person who is not resident of the other Contracting State; and (c) the remuneration is not borne by a permanent establishment which that person has in the other Contracting State. 2. Notwithstanding the provisions of paragraph 1, remuneration in respect of an employment exercised aboard a ship or aircraft in international traffic may be taxed in the Contracting State in which the place of effective management of the enterprise is situated.

Cultivation, manufacturing and production - Harvesting machine owners who supervise a group of operators admitted in accordance with the applicable provisions. - Purchasing and production personnel, at management level, who carry out commercial operations for an enterprise located in the territory of another Party. Marketing - Market researchers and analysts who conduct research or analysis independently or for a company located in the territory of another Party. - Trade show and promotional staff attending trade conventions. Sales - Sales representatives and sales agents who place orders or negotiate contracts for goods and services for an enterprise located in the territory of another Party, but do not deliver the goods or provide the services. - Buyers making purchases for an enterprise located in the territory of another Party. Distribution - Transport operators that carry out transport operations of goods or passengers to the territory of one Party from the territory of the other Party, or carry out loading and transport operations of goods or passengers from the territory of one Party to the territory of the other Party, without unloading operations, in the territory of the other Party. - Customs brokers who provide advisory services for the purpose of facilitating the import or export of goods. After-sales services - Installation, repair, maintenance, and supervisory personnel who have the technical expertise essential to fulfill the seller's contractual obligation; and who provide services, or train workers to provide such services, under a warranty or other service contract related to the sale of commercial or industrial equipment or machinery, including computer software purchased from an enterprise located outside the territory of the Party from which temporary entry is sought, during the term of the warranty or service contract. General Services - Professionals conducting business activities at the professional level within the scope of Section D. - Management and supervisory personnel engaged in business operations for an enterprise located in the territory of the other Party. - Financial services personnel (insurance agents, banking personnel or investment brokers) engaged in commercial transactions for an enterprise located in the territory of the other Party. - Public relat...

Business Visitors. 1. Each Party shall grant temporary entry and supporting documentation to issue a business person seeking to carry out any business activity listed in the appendix 7.04 (a) (1), without requiring requirements other than those established by the existing immigration measures applicable to temporary entry; and if: a) Proof of nationality of a party; and b) The purpose of entry. 2. Each Party shall grant temporary entry on terms no less favourable than those provided for in the measures listed in appendix 7.04 (2) (a), to business persons seeking to carry out certain business activities other than those listed in the appendix to 7.04 (a) (1). 3. No party may: a) Requiring as a condition for authorizing temporary entry under paragraph 1 or 2, prior approval procedures, requests, labour certification tests or other procedures of similar effect; or b) A numerical restrictions impose or maintain temporary entry in accordance with paragraph 1 or 2. 4. Notwithstanding paragraph 3. a Party may require a business person seeking temporary entry under this section to obtain a visa prior to entry or equivalent document. The Parties shall consider avoiding or removing their visa or equivalent document requirement.
Business Visitors. (a) Korea shall grant temporary entry to a business visitor for a period of not more than 90 days; and (b) India shall grant temporary entry to a business visitor for a period of not more than 180 days or for longer duration for a maximum period up to five years with 180 days stay stipulation on a single visit; and Such a business visitors’ visa under subparagraphs (a) and (b) shall be granted, provided that the business visitor: (i) complies with immigration measures applicable to temporary entry; (ii) presents proof of nationality of the other Party; (iii) is an employee of a juridical person not already having commercial presence in the host country; and (iv) does not receive any remuneration from a source located within the visiting Party; Neither Party may require labour market test as a condition for temporary entry or impose numerical restriction relating to temporary entry for business visitors.

Sales – Sales representatives and agents taking orders or negotiating contracts for goods or services for an enterprise located in the territory of the other Party but not delivering goods or providing services. – Buyers purchasing for an enterprise located in the territory of the other Party.
