The Academy Trust shall comply with the requirements of the Education (Independent School Standards) (England) Regulations 2010 (or such other regulations as may for the time being be applicable) in relation to requiring enhanced criminal records checks, obtaining enhanced criminal records certificates and making any further checks, as required and appropriate for members of staff, supply staff, individual Governors and the Chair of the Governing Body.

Disclosure and Barring Service Checks. 18Your employment is subject to a satisfactory report from the Disclosure and Barring Service. The Trust retains the right to request that a further disclosure is sought at a future time. You are not entitled to withhold any information about any convictions or cautions, which for other purposes under the Rehabilitation of Offenders Act would be regarded as spent.
Disclosure and Barring Service Checks. 4.1 The Hirer shall ensure that if it or any individuals engaged by it including its staff, volunteers and member of management committee undertakes any Regulated Activity as defined by the Safeguarding Vulnerable Groups Xxx 0000, then it must ensure that a valid enhanced disclosure check for regulated activity is undertaken through the Disclosure and Barring Service (DBS); and monitor the level and validity of the checks for each individual engaged by it.
4.2 The Hirer must not employ or use the services of any person who is barred from, or whose previous conduct or records indicate that he or she would not be suitable to carry out Regulated Activity or who may otherwise present a risk to the people present at the premises.
4.3 The Hirer warrants that at all times for the purposes of this agreement it has no reason to believe that any person who is or will be employed or engaged by the Hirer during the use of the premises is barred from the activity in accordance with the provisions of the Safeguarding Vulnerable Groups Act 2006 and any regulations made thereunder, as amended from time to time.
4.4 The Hirer shall immediately notify the School of any information that it reasonably requests to enable it to be satisfied that the obligations of this clause 4 have been met.
4.5 Harrow LSCB (Local Safeguarding Board) have launched the Green Book which is for all community, voluntary, faith and private sector organisations in Harrow that work with children and young people. This book gives complete guidance, support and advice to organisations on their obligations when dealing with children and young people. Disclosure and Barring Service Checks. 16.1 All Members agree to ensure that all Member Representatives, their Nominees and all Sub-Group members undergo an enhanced Disclosure and Barring Service check and refer to the Chair any concerns that arise from such checks
Disclosure and Barring Service Checks. 7.1 The Council shall: To the extent that the Council’s staff, employees and/or persons carrying out the services under the Agreement on their behalf are engaged in a ‘regulated activity’ (as defined by the Safeguarding Vulnerable Groups Act 2006 (SVGA 2006), ensure that such individuals are subject to a valid enhanced disclosure check for regulated activity undertaken through the Disclosure and Barring Service and;
(a) Monitor the level and validity of the checks under this Clause 7 for each member of staff.
(b) not employ or use the services of any person who is barred from, or whose previous conduct or records indicate that he or she would not be suitable to carry out regulated activity (as defined by the SVGA 2006) or who may otherwise present a risk to children or vulnerable adults.
7.2 The Council warrants that at all times for the purposes of this Agreement it has no reason to believe that any person who is or will be employed or engaged by the Council in the provision of the Services is barred from the activity in accordance with the provisions of the SVGA 2006 and any regulations made thereunder, as amended from time to time.
7.3 The Council shall immediately notify the Educational Institution of any information that it reasonably requests to enable it to be satisfied that the obligations of this Clause 7 have been met.
7.4 The Council shall refer information about any person carrying out the Services to the DBS where it removes permission for such person to carry out the Services (or would have, if such person had not otherwise ceased to carry out the Services) because, in its opinion, such person has harmed or poses a risk of harm to children OR vulnerable adults.
Disclosure and Barring Service Checks. It may be necessary for the hirer to undergo a disclosure and barring services check via the Disclosure and Barring Service (DBS). If a particular letting involves contact with children and young people, it is the responsibility of the hirer, as advised by the Headteacher, to ensure that they have complied with the DBS Code of Practise. When there is a requirement for DBS checks to be undertaken, the hirer must keep appropriate records in line with the DBS Code of Practice and report to the school any safeguarding concerns which may arise. The hirer will be required to provide evidence that DBS checks have been carried out on request.
