Discrepancy Sample Clauses

Discrepancy. ‌ (a) If the examination referred to in clause 6.2 reveals an underpayment or outstanding amounts owed to the Licensor in a Reporting Period: (i) the Licensee must promptly pay the Licensor the outstanding amount; and (ii) of 7% or more of Fees due in the Reporting Period, the Licensee must pay the Licensor the Licensor's reasonable costs for performing the examination.

Discrepancy. Customer shall review reports received under the Service promptly to ensure accuracy and completeness of the information. If Customer fails to notify Bank within thirty (30) days after receipt of a report that any information is inaccurate, incomplete, unclear, unreadable, or otherwise unacceptable, the Customer shall be deemed to have accepted the report and to have waived (i) any and all objections including but not limited to objections concerning its accuracy, completeness, clarity, readability or quality, and (ii) the right to bring any action or raise any claim against Bank based on any such objection. Bank shall not be liable for any loss, including loss of interest, resulting from Customer’s failure to give such notice and Customer shall be precluded from asserting such discrepancy against Bank.

Discrepancy. In regard to all Products sold by Sensor-Technik to Xxxxx, if, after delivery, Xxxxx discovers any discrepancy between (i) the quantity or type of Products ordered and that received or (ii) the quantity or type of Products invoiced and that received, Xxxxx shall use best efforts to timely give notification of the discrepancy. Appropriate adjustments shall be made in the ordinary course.

Discrepancy. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, Entry Form, or point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control.

Discrepancy. If any error in favor of either Party is discovered in the course of inspection under this Section 3.9, the other Party, within [*] after the accounting firm’s disclosure of its findings, shall pay the first Party the amount (plus interest, if applicable) that the first Party would have received in the absence of such error. Inspections conducted under this Section 3.9 shall be at the expense of the inspecting Party, unless a variation or error in favor of the inspected Party exceeding [*] of the amount actually paid for the period covered by the inspection is established in the course of such inspection, whereupon all costs in connection with such inspection for such period will be paid by the inspected Party within [*] after the accounting firm’s disclosure of its findings.

Discrepancy. In case of any discrepancy between this Agreement, the Schedules or the Security Documents, this Agreement shall prevail.
