MISTAKES. If we have acted in accordance with your instructions and your funds have been sent to the wrong account as a result of a mistake made by you we are under no obligation to recover the funds or to resend the funds to the correct Beneficiary. If we have made a mistake by sending the funds to the wrong account, we will take immediate action at our expense to recover those funds and resend them to the correct account. We may Close Out a particular transaction or all transactions you have with us without notice if:

MISTAKES. 16.1. The Client who notices that the funds that do not belong to him have been transferred to his Account must immediately notify Stanhope Financial. In such cases, the Client, as the unauthorized beneficiary of the transferred funds of the Payment Transaction, shall be deprived of the right to dispose of the transferred funds and must immediately remit such funds to the Account designated by Xxxxxxxx Financial. 16.2. Stanhope Financial shall have the right to debit the amounts incorrectly credited to the Account through its own fault without a separate consent of the Client, as unauthorized beneficiary of transferred funds of the Payment Transaction and remit such funds to their due beneficiary. 16.3. If funds available in the Account are already insufficient for the debit of incorrectly credited funds, the Client must repay the respective amount of funds to the account designated by Stanhope Financial within 3 (three) Business Days of Stanhope Financial’s request. If the Client fails to return the money credited by mistake in time, at the request of Xxxxxxxx Financial, the Client shall pay Stanhope Financial daily penalties of 0.05 percent for each day by which the time limit has been exceeded.
