Discretionary Practices. Both parties acknowledge that certain discretionary practices exist within the employer/employee relationship, which do not have a material effect on the conditions of employment, such as staff recognition celebrations. The parties agree that such practices shall continue to exist at the sole discretion of the City.

Discretionary Practices. No discretion or power under the Schemes has ever been exercised:- (a) to increase pensions in payment; (b) to provide enhanced or new benefits in relation to any employee or officer currently in the service of the Company, or in relation to any other employee or officer since the Schemes were established;

(b) Save as disclosed in such written details in respect of each Pension Scheme or PHI Scheme, no power or discretion has been exercised and no intention to so exercise has been communicated: (i) to admit to membership any employee or officer who would not otherwise have been eligible for membership; or (ii) to pay a contribution which would not otherwise have been paid or to augment or provide in respect of any past or present employee or officer of the Irish Companies or dependant or beneficiary of any such person a benefit which would not otherwise have been paid.
Discretionary Practices. No discretion or power has been exercised under any of the Pension Schemes or the PHI Scheme in respect of any past or present employee or officer or dependant of any of them to: (a) augment benefits; or (b) admit to membership any person who would not otherwise have been eligible for admission to membership; or (c) admit to membership any person on terms which provided for or envisaged the payment of a transfer value or a transfer of assets from another scheme to any of the Pension Schemes in a case in which the payment or transfer has not been made or has not been made in full; or (d) provide a benefit which would not otherwise be provided; or (e) pay a contribution which would not otherwise have been paid.

  • Policies and Practices The employment relationship between the Parties shall be governed by this Agreement and the policies and practices established by the Company and the Board of Directors (hereinafter referred to as the “Board”). In the event that the terms of this Agreement differ from or are in conflict with the Company’s policies or practices or the Company’s Employee Handbook, this Agreement shall control.
