Effect of Releases. Mortgagee and the Secured Parties, without notice, may release any part of the security described herein, or any person or entity liable for any Indebtedness without in any way affecting the lien hereof upon any part of the security not expressly released, and may agree with any party obligated on said Indebtedness or having any interest in the security described herein to extend the time for payment of any part or all of the Indebtedness. Such agreement shall not in any way release or impair the lien hereof, but shall extend the lien hereof as against the title of all parties having any interest in said security, which interest is subject to said lien, and no such release or agreement shall release any person or entity obligated to pay any Indebtedness.
Effect of Releases. Effect of Releases. Payment will be made as soon as practicable (but not later than 70 days) after the designated payment date except that if the timing of any payment is contingent on employee action, such as execution of a release of claims or agreement, and the specified payment period straddles two calendar years, payment will be made on the second such calendar year.
Effect of Releases. With respect to any and all Released Claims, effective upon Final Approval, the Representative Plaintiffs, for themselves and as the representatives of the Settlement Class, and on behalf of each Settlement Class Member who has not timely opted out and all Releasing Parties, shall expressly waive, and each Settlement Class Member and Releasing Party shall be deemed to have waived, and by operation of the judgment of the Court shall have expressly waived, any and all claims, rights, or benefits they may have under California Civil Code § 1542 and any similar federal or state law, right, rule, or legal principle that may be applicable. The Parties agree and acknowledge that this waiver is an essential term of this Agreement. California Civil Code § 1542 provides as follows:

The Parties agree and acknowledge that this waiver is an essential term of this Agreement. California Civil Code § 1542 provides as follows: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

Effect of Releases. This Settlement Agreement may be pleaded as a full and complete defense to any action, suit or other proceeding that may be instituted, prosecuted or attempted with respect to any of the Released Claims. The parties hereto further agree that this Settlement Agreement may be pleaded as necessary for the purpose of enforcing this Settlement Agreement. The foregoing mutual releases shall not apply to any claim for breach of this Agreement, and each of the parties hereto retains the right to bring suit to enforce this Agreement or to seek damages arising out of any breach thereof.

California Civil Code § 1542 provides as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
Effect of Releases. (a) By signing below, each Party acknowledges that this Deed of Release has been executed voluntarily and that each has had the opportunity to obtain the advice of an attorney or a representative of their choice prior to executing this Deed of Release, and that each, respectively, has a full understanding of the terms of this Deed of Release, and that accordingly, in the event of any dispute involving the scope, meaning or effect of this Deed of Release, nothing herein shall be construed in favor of any Party as against any other.
(b) As to the Claims released herein, each Party expressly waives, to the fullest extent permissible under law, any and all rights that such Party may have or purport to have under any provision of law that in any way limits or qualifies the terms of a release of Claims at the time of the execution of this Release. Upon the advice of counsel, any such provision of common or statutory law is hereby expressly waived by the releasing Parties. Specifically, and without in any way limiting the foregoing, the releasing Parties, upon the advice of legal counsel, hereby waive any contrary rights under any applicable law.
