(hereinafter referred to as the “Company”) and UFCW CANADA LOCAL 1000A (hereinafter referred to as the “Union”) Re: Opening of Fountain Street Distribution Facility Notwithstanding any terms in the collective agreement to the contrary, the parties have agreed to the following:: The Company will use its best efforts to project total full time job requirements which it anticipates for the Fountain Street distribution facility when it is fully operational ((‘the projected full time jobs”). At present, the Company anticipates that this will be achieved by the end of March, at which point there will be approximately full time jobs in two operating areas: grocery and perishable. The Company will also use its best efforts to identify for each shift and in each area the number of employees in the Warehouse-person classification who will be performing the jobs of janitor and clerk. The Company will post all the projected full time jobs, first to full time employees in existing Local distribution facilities, secondly to full time employees in non-Local distribution facilities and thirdly to part time employees in existing Local distribution facilities. This process will be completed before the Fountain Street distribution facility opens. The manner in which the Company will conduct this “initial application process” is as described in this letter of understanding. The Company will prepare an application form consisting of a list of all of the projected full time jobs. For each job, the list will specify (a) the classification, for the Warehouse-person classification, whether the position is janitor or a clerk the shift, and the area of the building in which the employee will normally work. shall mean the days of the week, and the time of day (i.e. day, afternoon or evening) that the employee holding the job will be regularly scheduled to work. The application forms will be made available to employees a reasonable amount of time prior to the closing date. An employee will be entitled to apply for as many jobs on the list as the employee wishes by marking on the list the jobs in which the employee is interested. In applying for jobs, the employee shall indicate an order of preference. For greater clarity, an employee may apply for jobs notwithstanding Article of the distribution facilities collective agreements. The Company will award the projected full time jobs to applicants on the basis of seniority provided that the employee who is applying for the vacancy possesses the qualifications and ability necessary to perform the work in question. For this purpose, the full time seniority lists at all of the Local distribution facilities will be considered to be dove-tailed.
