ENGINEER’S FEE. If the Engineer for the Xxxxxxx Improvements is the same as the Engineer for the CID Improvements and the other infrastructure improvements on the Project Site, then Developer, as the City's design and construction manager, shall cause the Engineer's fee for preparation of the Engineering Plans and the Engineer's fee for construction of the Xxxxxxx Improvements to be clearly differentiated from other CID Improvements and the other improvements to the Project Site. The Engineer's fee estimate shall include a detailed breakdown of direct labor hours, hourly rates, overhead, and proposed profit for all major project elements of the Xxxxxxx Improvements.

ENGINEER’S FEE. The Owner shall compensate the Engineer as full compensation for his services, in accordance with the terms and conditions of this agreement as follows: Base Project: A fixed fee of $109,765.50 plus an allowance of $15,580 for the scope outlined in Exhibits B1-B6. 0xx Xxxxxx Xxxxxxxxx (XxXxxxxx Xxxxxx to Xxxxxxxx Avenue) A fixed fee of $8,365 for the scope outlined in Exhibits B1. This fee is based on the alternate portion being design concurrently with the base project.
ENGINEER’S FEE. The above listed services shall be accomplished in accordance with the provisions noted in each task letter prepared by the DPW for each project. The total fixed fee for such services noted in each task letter shall be an amount determined by the Engineer and the Commissioner of the DPW, hereinafter referred to as the "Commissioner." Such letters shall be issued during the duration of this contract and shall include a specific time frame for completion of each task. Each task letter shall reference a DPW project number. No work shall be performed until the Engineer receives the signed task letter. No payments shall be made until the materials submitted have been approved by the DPW. No adjustments shall be made in said fee unless the scope of the work to be performed by the Engineer is substantially changed, as determined by the Commissioner. No work relative to such substantial change shall be performed by the Engineer prior to receiving DPW written authorization to proceed. Said fee includes all costs of living, transportation and communication, whether within or without the State of Connecticut, connected with the discharge of the Engineer's duties under this contract unless express written notification to the contrary is received from the State. Except as hereinafter mentioned, the maximum total cumulative fee allowed the Engineer under this contract shall not exceed Two Hundred Thousand Dollars ($200,000.00). Whenever services are completed under this contract for which the Engineer is entitled to 75% of the maximum total cumulative fee, the Engineer shall promptly notify the DPW in writing of the services completed to date and a projection of the level of effort necessary to complete the remaining hourly-rate assigned tasks. The DPW shall, within thirty (30) working days of the receipt of the written notification, order the Engineer to complete said tasks irrespective of the fact that the maximum total cumulative fee may be exceeded or order a reduction in the work included in said tasks to avoid exceeding the maximum total cumulative fee. If the maximum total cumulative fee is to be exceeded, the prior written approval of the State Properties Review Board shall be necessary. The Engineer shall be entitled to a payment of Ten Dollars ($10.00) at the termination of this contract if at such time the Engineer has not received any fee under this contract.
