Actual Construction Cost definition

Actual Construction Cost means the aggregate amounts required to be ------------------------ paid to Contractor, Subcontractors and other Persons (i) to complete the work required by the Contractor under the Construction Contract, (ii) to provide oversight and auditing of the Contractor in addition to that contemplated in the original Project Budget or (iii) in connection with the preparation and execution of the First Amendment to Credit Agreement. The amounts paid as Actual Construction Cost shall include, and be limited to: (i) the Separated Contract Price; (ii) any other amounts which may be owed to the Contractor and any Subcontractor for completion of the work required by the Contractor under the Construction Contract; (iii) reasonable costs paid to the Independent Engineer to monitor the work performed under the Construction Contract; (iv) reasonable costs of personnel to provide management and engineering oversight of the work performed under the Construction Contract; (v) reasonable legal and accounting work required to monitor and audit work performed under the Construction Contract and payments made to the Contractor and Subcontractors; and (vi) costs to prepare and execute the First Amendment to Credit Agreement.
Actual Construction Cost means the cost of all portions of a project to construct the work as shown on the approved construction documents and as necessary to comply with the California Building Standards Code, generally based upon the sum of the construction contract(s), when applicable, and other direct construction costs; including but not limited to mobilization, general and special conditions, supervision and management, overhead, markups and profit, demolition, building pad construction (including but not limited to grading, soil remediation, excavation, trenching, retaining, shoring, etc.), temporary construction and barriers, materials, supplies, machinery, equipment, labor cost or the wages paid to the workers doing the work, etc., as certified by the hospital governing board or authority. Construction cost does not include the compensation paid to the designer(s), inspector(s), plan review and building permit, the cost of the land, rights-of-way, work outside the scope of OSHPD’s jurisdiction, mobile equipment and furnishings, or other costs which are defined in the contract documents as not a part of the work. Work requiring a plan approval and/or building permit issued by the Office which is identified as not in the scope of the work and/or not in contract (NIC) shall be performed under a separate building permit.

The amounts paid as Actual Construction Cost shall include, and be limited to: (i) any amounts which have been paid or which may be owed to Original Contractor, Contractor or any Subcontractor for completion of the work required by Original Contractor under the Original Construction Contract and the Contractor under the Construction Contract; (ii) reasonable costs paid to the Independent Engineer to monitor the work performed under the Original Construction Contract and under the Construction Contract; (iii) reasonable costs of personnel to provide management and engineering oversight of the work performed under the Original Construction Contract and under the Construction Contract; (iv) reasonable legal and accounting work required to monitor and audit work performed under the Original Construction Contract and under the Construction Contract and payments made to Original Contractor, Contractor and Subcontractors; and (v) costs to prepare and execute the First Amendment to Credit Agreement and Second Amendment to Credit Agreement.

More Definitions of Actual Construction Cost

Actual Construction Cost means the actual cost to construct the Shell Building (excluding Tenant Finish) and Land Sitework, pursuant to the Construction Plans and any changes thereto, including but not limited to (a) site preparation, (b) storm drainage, (c) site lighting, (d) landscaping and irrigation, (e) paving and striping, (f) utility connections, (g) construction testing services (h) costs of labor and materials, (i) fees and other charges payable to the Contractor, (j) fees to governmental authorities for permits, inspections, and certificates of occupancy, (k) utilities during construction, (l) performance bonds, and (m) architectural fees. Actual Construction Cost shall specifically exclude (1) leasing commissions, (2) construction interest and loan fees, (3) development fees, and (4) construction management other than the Contractor, all of which shall be borne entirely by Landlord. Landlord agrees and represents that the Actual Construction Cost shall be equal to the Stipulated Sum, unless such costs are increased or decreased as a result of Change Orders to the Construction Plans pursuant to Section 11 hereof.
Actual Construction Cost means the actual total cost of constructing the building in which the Premises are to be located, and the attendant parking facilities, but specifically excluding individual tenant improvements.   • Direct Construction Cost shall have the meaning set forth in Article 11.

  • Estimated Construction Cost or “ECC” means the amount calculated by Contractor for the total cost of all elements of the Work based on this Agreement available at the time(s) that the ECC is prepared. The ECC shall be based on current market rates with reasonable allowance for overhead, profit and price escalation and shall include and consider, without limitation, all alternates and contingencies, designed and specified by A/E and the cost of labor and materials necessary for installation of Owner furnished equipment. The ECC shall include all the cost elements included in the AACC, as defined above, and shall represent Contractor’s best current estimate of the Guaranteed Maximum Price it will propose for the Project based on the information then available. The ECC shall not include Contractor’s Pre-Construction Phase Fee, A/E’s Fees, the cost of the land and rights-of-way, or any other costs that are the direct responsibility of Owner.

  • Begin actual construction means in general, initiation of physical on-site construction activities on an emissions unit which are of a permanent nature. Such activities include, but are not limited to, installation of building supports and foundations, laying of underground pipework, and construction of permanent storage structures. With respect to a change in method of operating this term refers to those on-site activities other than preparatory activities which mark the initiation of the change.

  • Construction Cost means and includes the cost of the entire construction of the Project, including all supervision, materials, supplies, labor, tools, equipment, transportation and/or other facilities furnished, used or consumed, without deduction on account of penalties, liquidated damages or other amounts withheld from payment to the contractor or contractors, but such cost shall not include the Consulting Engineer/Architect's fee, or other payments to the Consulting Engineer/Architect and shall not include cost of land or Rights-of-Way and Easement acquisition.
