ENGINEER’S STATUS DURING CONSTRUCTION. 9.01 Engineer’s Status A. Engineer will be Owner’s representative during construction. The duties and responsibilities and the limitations of authority of Engineer as Owner’s representative during construction are set forth in this Contract. B. Neither Engineer’s authority or responsibility under this Article 9 or under any other provision of the Contract, nor any decision made by Engineer in good faith either to exercise or not exercise such authority or responsibility or the undertaking, exercise, or performance of any authority or responsibility by Engineer, shall create, impose, or give rise to any duty in contract, tort, or otherwise owed by Engineer to Contractor, any subcontractor, any supplier, any other individual or entity, or to any surety for or employee or agent of any of them. C. Engineer will make visits to the Site at intervals appropriate to the various stages of construction. Engineer will not be required to make exhaustive or continuous inspections on the Site to check the quality or quantity of the Work. D. Engineer has the authority to reject Work if Contractor fails to perform Work in accordance with the Contract Documents. E. Engineer will render decisions regarding the requirements of the Contract Documents, and judge the acceptability of the Work. F. Engineer will not supervise, direct, control, or have authority over or be responsible for Contractor’s means, methods, techniques, sequences, or procedures of construction, or the safety precautions and programs, or for any failure of Contractor to comply with Laws and Regulations applicable to the performance of the Work. Engineer will not be responsible for Contractor’s failure to perform the Work in accordance with the Contract Documents.

CITY'S REPRESENTATIVE - Unless otherwise provided elsewhere in the Contract Documents, the CITY’s Engineer (“Engineer”) will be CITY's representative during the construction period. The duties and responsibilities and the limitations of authority of Engineer as CITY's representative during construction are set forth in Articles 1 through 15 of these General Conditions. Should the CITY appoint as its representative a party other than the Engineer, such CITY'S Representative shall have the same authority and duties as those assigned to the Engineer hereunder.
ENGINEER’S STATUS DURING CONSTRUCTION. A. Visits to Site. Engineer will make visits to the Site at intervals appropriate to the various stages of construction as Engineer deems necessary in order to observe as an experienced and qualified design professional the progress that has been made and the quality of the various aspects of Contractor’s executed Work. Engineer at an initial meeting at the site will provide Contractor with a schedule of stages of the Work at which mandatory inspection must be called for by Contractor. Contractor shall provide Engineer and Owner’s Representative of at least 48 hours notice of when a stage of the Work requiring mandatory inspection is to take place. Based on information obtained during such visits and inspections, Engineer, for the benefit of Owner, will determine if the Work is proceeding in accordance with the Contract Documents.

ENGINEER’S STATUS DURING CONSTRUCTION. OWNER’S REPRESENTATIVE: 9.1 The duties and responsibilities and the limitations of authority of ENGINEER as an OWNER'S representative during construction are set forth in the Contract Documents, and shall not be extended without written consent of OWNER and ENGINEER. Notwithstanding anything to the contrary herein, in all instances in the Contract Documents where ENGINEER has the authority to make decisions concerning quality of and acceptance of the Work performed by CONTRACTOR the ENGINEER shall first discuss such decision and proposed acceptance with OWNER and obtain its approval prior to communicating with the CONTRACTOR. Further, in all instances in the Contract Documents where ENGINEER has the authority to make a decision that impacts the Project budget or Contract Price or payment to the CONTRACTOR, then ENGINEER shall first discuss the payment or costs with OWNER and obtain its approval prior to approving any payment, additive or deductive Work. This paragraph is not intended as and shall not be a waiver of ENGINEER’S responsibility for oversight of the Work. VISITS TO SITE: 9.2 ENGINEER will make visits to the site at intervals appropriate to the various stages of construction to observe the progress and quality of the executed Work and to determine, in general, if the Work is proceeding in accordance with the Contract Documents. ENGINEER will not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. ENGINEER'S efforts will be directed toward providing for OWNER a greater degree of confidence that the completed Work will conform to the Contract Documents. On the basis of such visits and on-site observations, as an experienced and qualified design professional, ENGINEER will keep OWNER informed of the progress of the Work, and will endeavor to guard OWNER against defects and deficiencies in the Work. CLARIFICATIONS AND INTERPRETATIONS: 9.3 ENGINEER will issue, with reasonable promptness, such written clarifications or interpretations of the Contract Documents (in the form of drawings or otherwise) as ENGINEER and OWNER may determine necessary, which shall be consistent with, or reasonably inferable from, the overall intent of the Contract Documents. If CONTRACTOR believes that a written clarification or interpretation justifies an increase in the Contract Price or Contract Time, CONTRACTOR may make a claim therefore, as provided in Article 11 or Article 12.
