Common use of Entitlement to Other Sick Leave Clause in Contracts

Entitlement to Other Sick Leave. When a member of the bargaining unit is absent from duties on account of illness or accident for a period of five (5) months or less, the amount deducted from the salary due the employee shall not exceed the sum which is actually paid a substitute employee or if no substitute is employed due to inadequate notice to the District, the amount that would have been paid a substitute. Accumulated sick leave, catastrophic leave donations, and any accrued vacation is to be considered part of the five-(5) month allocation for the purpose of calculation of pay. Notice is defined as less than 60 minutes prior to the start of the employee’s work shift.
