The Executive Agent or designated agent of the Government of the Russian Federation shall examine all equipment, supplies, and other materials in each shipment received pursuant to this Agreement and within ten (10) days of receipt shall provide written confirmation to the Executive Agent of the Government of the United States of America, its designated agent or contractor of acceptance or rejection based on whether the equipment, supplies, or other materials conform to specifications mutually coordinated in advance for said equipment, supplies or other materials. Upon request, one or more representatives of the Government of the United States of America or its designated agent may be present at the examination of the equipment, supplies, materials, or other assistance being delivered. Basic certification procedures shall be agreed in writing by the Executive Agents. Equipment Certification. (a) The RE Supplier confirms that the Generating Technology either (i) has been employed in commercial applications and operated reliably for three years before the date of the submission of the Proposal; or (ii) will be Certified on or before Commercial Operation.
(b) If the Generating Technology has not been employed in commercial applications and operated reliably for three years before the date of the submission of the Proposal, then
(i) if, as of the Effective Date, the Generating Technology has not yet received Certification, the Seller is required to deliver Equipment Certification Security hereunder; and
(ii) If, by Commercial Operation, the Generating Technology has not received Certification, the RE Supplier shall pay to BLPC an amount equal to the Equipment Certification Security as liquidated damages on account of the Generating Technology not being so Certified.
Equipment Certification. At all times in which the EV Charging Station is connected with the Borough’s electric system, the EV Charging Station and associated equipment must be compliant with the current National Electric Code and the Borough’s Technical Requirements unless the requirement is specifically waived in writing by the Borough. In addition, the EV Charging Station and associated equipment must be compliant with the applicable American National Standards Institute (ANSI) and Underwriters Laboratories (UL) standards, including but not limited to the following: ANSI/UL 2202 (DC Charging Equipment for Electric Vehicles), ANSI/UL 2594 (Electric Vehicle Supply Equipment), UL 2750 (Outline of Investigation for Wireless Power Transfer Equipment for Electric Vehicles), UL 9741 (Electric Vehicle Power Export Equipment), ANSI/UL 2231-1 (Personnel Protection Systems for Electric Vehicle Supply Circuits: General Requirements), and ANSI/UL 2231-2 (Personnel Protection Systems for Electric Vehicle Supply Circuits: Particular Requirements for Protection Devices for Use in Charging Systems) (or subsequent approved revisions of the foregoing). By signing this Application/Agreement in Section 9, Applicant certifies that the installed equipment and technology meet the preceding requirement(s) and Applicant has attached the manufacturer’s documentation for verification.
