Equipment Consumables. It is agreed that Homeland Security vehicles (e.g. trucks, trailers, etc.) acquired by the County and assigned to the HMRT will be the sole responsibility of the agency the vehicle is assigned to, to maintain and replenish consumables on the vehicle to ensure operational readiness at all times.

Equipment Consumables. Exhibitor is required to use Barco approved consumables. Use of non-Barco approved consumables such as lamps, reflectors and coolant shall void the Warranty unless waived by Barco in writing, in which event the Warranty shall continue pursuant to the terms of this Agreement.
Equipment Consumables. (a) The Supplier must provide at its expense all consumables, equipment and materials that are necessary to provide the Services other than any consumables, equipment and materials which are agreed in writing to be provided by the Customer. (b) The Supplier acknowledges and agrees that the Supplier will be responsible for: (i) any loss, damage or injury arising from the use of equipment when providing Services, including without limitation the cost of repairing or replacing any equipment; and (ii) ensuring that the relevant equipment is safe and without risks to health and safety when properly used.
Equipment Consumables. Buyer agrees to purchase from NantCell, and NantCell agrees to manufacture and sell to Buyer, (a) bioreactors incorporating next-generation proprietary technology called “GMP in a box,” that have been optimized to produce/generate stem cells and/or novel protein based therapies, including antibodies, as a result of the Development Activities and that conform to specifications that are mutually agreed by the Parties in writing (the “Equipment”) and (b) reagents/consumables needed for the use of the Equipment (“Consumables”). NantCell shall also provide to Buyer: (i) reasonably detailed, accurate, written instruction manuals with respect to the operation and use of the Equipment and Consumables purchased by Buyer; and (ii) upon request and at Buyer’s facilities, initial training on the operation and use of the Equipment. In addition, NantCell hereby grants to Buyer a perpetual, non-assignable, non-sublicenseable, non-exclusive, royalty-free, fully paid-up, worldwide license to use and otherwise exploit the bioreactor software, with access to updates to the bioreactor software during the warranty period. Further, if requested by Buyer, NantCell will negotiate in good faith and enter into an agreement with Buyer for the provision of ongoing maintenance services for the Equipment following the applicable warranty period. Promptly following completion of the Development Activities and mutual agreement by the Parties on specifications for the Equipment, NantCell shall provide to Buyer a list of the Consumables and may update such list from time to time upon written notice to Buyer.

  • Consumables During the design phase, Purchaser may participate in the selection of suppliers of consumables of the Supplier. In such case, the choice regarding the final selection of the said suppliers shall be mutually agreed between the Parties. Two suppliers shall be identified and selected for each type of consumables.

  • Equipment Cleaning (a) Areas, known by Forest Service prior to timber sale advertisement, that are infested with invasive species of concern are shown on Sale Area Map.   • Capital Equipment Collaborator’s commitment, if any, to provide ICD with capital equipment to enable the research and development activities under the Research Plan appears in Appendix B. If Collaborator transfers to ICD the capital equipment or provides funds for ICD to purchase it, then ICD will own the equipment. If Collaborator loans capital equipment to ICD for use during the CRADA, Collaborator will be responsible for paying all costs and fees associated with the transport, installation, maintenance, repair, removal, or disposal of the equipment, and ICD will not be liable for any damage to the equipment.

  • Tooling Unless otherwise specified in this Agreement, all tooling and/or all other articles required for the performance hereof shall be furnished by Seller, maintained in good condition and replaced when necessary at Seller's expense. If NETAPP agrees to pay Seller for special tooling or other items either separately or as a stated part of the unit price of Goods purchased herein, title to same shall be and remain in NETAPP upon payment therefore.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties. This paragraph shall apply to all new types of equipment including office and clerical equipment. In the event an agreement cannot be reached within sixty (60) days after the date such equipment is put into use, the matter may shall be submitted to the National Grievance Committee for final disposition. Rates agreed upon or awarded shall be effective as of the date equipment is put to use

  • Equipment The Fund shall obtain and maintain at its own cost and expense all equipment and services, including but not limited to communications services, necessary for it to utilize the Software and obtain access to the System, and Custodian shall not be responsible for the reliability or availability of any such equipment or services.

  • Electrical Equipment Residents must use only CSA, UL-approved or Canadian-certified electrical equipment; the rated wattage of light fixtures must never be exceeded; and only replacement bulbs supplied by Waterloo maintenance staff may be used.   • Equipment and Software To use the Mobile Remote Deposit Services, you must obtain and maintain at your expense, compatible equipment and software that we may specify from time to time.

  • Equipment Use Lessee agrees that the Equipment will be operated by competent, qualified personnel in connection with Lessee's business for the purpose for which the Equipment was designed and in accordance with applicable operating instructions, laws, and government regulations, and that Lessee shall use all reasonable precautions to prevent loss or damage to the Equipment from fire and other hazards. Lessee shall procure and maintain in effect all orders, licenses, certificates, permits, approvals, and consents required by federal, state, or local laws or by any governmental body, agency, or authority in connection with the delivery, installation, use, and operation of the Equipment.
